ARTICLE II. - LAW LIBRARY [28]


Sec. 34-31. - Purpose.

It is declared that the proper administration of justice and of the courts in the county make it desirable that there be available to the board of county commissioners and the judges and the officers of the several courts two complete law libraries, one to be located in Dade City and the other to be located in New Port Richey, and that the establishment of such law libraries is a public need and for general county purposes.

Sec. 34-32. - Established; location; operation.

There is established in the county two law libraries, one to be located in Dade City to be known as the East Pasco Law Library and the other to be located in New Port Richey to be known as the West Pasco Law Library. The libraries are established for the use of the board of county commissioners and the officers of the several courts and the members of the bar and the general public desiring access thereto. The law libraries shall be operated under such rules and regulations as the trustees of the respective law libraries shall prescribe.

Sec. 34-33. - Fee levied upon suits filed in circuit court and county court; disposition and administration of funds.

There shall be taxed and collected by the clerk of the circuit court of the county the sum of $25.00 as cost in each civil suit, action or proceeding instituted in the circuit court of the county and the sum of $15.00 as cost in each civil suit, action or proceeding instituted in the county court, in addition to the cost otherwise provided by law. The sum collected by the clerk should be deposited equally in two special funds, one fund to be used for the East Pasco Law Library and administered by its board of trustees as specified in section 34-34 and the other fund to be used for the West Pasco Law Library and administered by its board of trustees as specified in section 34-34.

Sec. 34-34. - Use of fees.

The law library funds collected pursuant to section 34-33 shall be expended for the purpose of procuring, maintaining, furnishing and equipping the respective law libraries and securing the services of a librarian for the law libraries. However, any funds not so needed may be ordered by the circuit court of the county to be paid into the general funds of the county.

Sec. 34-35. - Board of trustees.

The board of county commissioners shall appoint a board of trustees for each law library established in this article, and each board of trustees shall consist of three practicing attorneys. The board of county commissioners shall make the appointments to the board of trustees of the East Pasco Law Library from the recommendations made to it by the Pasco County Bar Association and to the West Pasco Law Library from the recommendations made to it by the West Pasco Bar Association. The three trustees on each board shall serve staggered terms of three years each. The board of trustees shall from time to time recommend to the board of county commissioners the purchase of books, supplies and equipment for such law libraries and such person to be designated as librarian.

Sec. 34-36. - Chairman of board of trustees; authority of board of trustees.

The board of trustees of each respective law library shall elect one of their number to serve as chairman. The board of trustees shall have the power and authority to place and enforce rules and regulations as to the use, operation and maintenance of the law libraries and means of ingress and egress thereto.
