ARTICLE II. - PROTECTION OF CERTAIN LAKES [103]


Sec. 246-36. - Dredging, construction or creating obstructions prohibited in certain lakes.

On and after the effective date of this act [article], it shall be unlawful for any person, firm or corporation to do any dredging, pumping of sand, extension of lands, construction or extension of islands, or to create any canal or inlets or to create any obstructions in or under the waters of Lake Saxon, 19-26-19E, 24-26-18E, 25-26-18E, 30-26-19E; Lake Padgett, 24-26-18E, 25-26-18E; King Lake, 7-26-19E, 12-26-18E; 13-26-18E, 18-26-19E; Bell Lake, 13-26-18E, 18-26-19E, except as hereinafter provided.

Sec. 246-37. - Permit required; operations restricted.

Any person, firm or corporation desiring to do any dredging, pumping of sand, extension of lands, construction or extension of islands or to create any obstructions in or under the waters of any of the said lakes, shall be subject to the following restrictions:

(1)

Prior to the beginning of any dredging operations in any of the above lakes, it shall be necessary to secure a permit from the game and fresh water fish commission.

(2)

There shall be no dredging within 200 feet of shoreline or in a water depth of less than ten feet.

(3)

There shall be no willful destruction of any aquatic vegetation by any such operations.

(4)

The game and fresh water fish commission may in its discretion issue and promulgate any rules or regulations with reference to the issuance of any such permits.

(5)

Any such operations must be completed within 22 working days.

(6)

Any such operations shall use only a suction-type dredge; a cutterhead shall not be permitted.

(7)

If excess stirring or muddy water occurs during any such operations, the operations shall cease immediately.

Sec. 246-38. - Docking rights of upland owners.

The provisions of this act [article] shall not deny the right of any upland owner to construct a dock or wharf in front of his upland as provided by the laws of this state.

Sec. 246-39. - Enforcement.

The provisions of this act [article] shall be enforced by local, county, and state enforcement officers including the game and fresh water fish commission.

Sec. 246-40. - Penalty for violations.

Any person violating any of the provisions of this act [article] shall be guilty of a misdemeanor and upon conviction shall be punished as provided by law.
