ARTICLE XIII. - NEWSPAPER VENDING MACHINES IN DOWNTOWN IMPROVEMENT DISTRICT, DOWNTOWN PARKS, PLAZAS, ETC. [75]


Sec. 16-321. - Regulations governing publication vending boxes incorporated by reference.

(a)

By Ordinance No. 69132 of March 23, 1989; Ordinance No. 69447 of May 11, 1989; Ordinance No. 72546 of November 1, 1990; and Ordinance No. 73646 of May 16, 1991, the City of San Antonio established regulations and a permitting system for publication vending boxes placed on public rights-of-way in the downtown area. Said provisions are incorporated herein by reference as if set out at length herein.

(b)

The purpose of these provisions was to rid the portion of the city which had been renovated under the Tri-Party Downtown improvements of the clutter of the various vending boxes, establish uniform and harmonious design for such boxes, limit locations to places where pedestrian traffic would not be impeded, and afford all publications equal and full access to the sidewalk areas for vending their publications.

(c)

The following changes are hereby made to the publication vending box regulations and the aforementioned ordinances are amended to the extent they are in conflict with the following:

(1)

Expansion of the regulated area from Tri-Party streets only to include all of the area presently within the established boundaries of the Downtown Improvement District as indicated on the Attachment A to Ordinance No. 79102, the city downtown parks and plazas, the Main Library and convention facilities.

(2)

Limiting publication vending outlets in the regulated area to the "Modular System" which has been one of two systems, and eliminating the "Hitching Post System."

(3)

The total number of locations is revised from a previous authorization of seventy-one (71) to one hundred twenty-six (126); the total number of spaces is increased from five hundred seven (507) to six hundred ninety-eight (698); certain locations are rearranged to accommodate changed demands resulting partially from the San Antonio Light newspaper no longer being in circulation; and space numbers are revised at previously authorized locations in order to streamline the permitting process (see Attachment C to Ordinance No. 79102).

(d)

Newspaper vending boxes. Annual fee for placement of a newspaper vending box in right-of-way in the downtown area: Fifty dollars ($50.00).
