ARTICLE I. - IN GENERAL


Sec. 22-1. - Restrictions on sale and use of alcoholic beverages in parks.

(a)

Except as provided in subsection (b), it shall be unlawful for any person to sell, possess, consume or distribute alcoholic beverages in any city park.

(b)

The following parks or park facilities are exempted from the restriction in subsection (a):

(c)

The director of parks and recreation or his designated representative is authorized to issue a special permit to allow the possession and consumption of alcohol within restricted parks for specific events. The director shall have authority to establish guidelines for the issuance of such permits imposing whatever conditions he deems appropriate.

Sec. 22-2. - Vendors operating in parks.

(a)

It shall be permissible for properly licensed vendors to offer for sale in city parks, prepared and packaged food items and soft drinks subject to the following restrictions:

(1)

Vendor's vehicles, carts and other conveyances shall be restricted to park roads and parking areas.

(2)

No vending shall be permitted in recreation or other park activity buildings.

(3)

Vending shall not be construed to mean dispensing of soft drinks or prepackaged food items from vending machines.

(4)

Vendors may not operate in any city park or park facility covered by a city concession contract.

(5)

Vendors shall not use any utility outlets in the conduct of their operations.

(6)

Vendors shall pick up trash and refuse accumulations in and around their area of operation.

(7)

Notwithstanding the preceding vending shall not be allowed in any portion of Woodlawn Lake Park or on any street adjacent to the park, except in the two (2) designated vending locations in the Island House Parking Lot. Vendors wishing to provide pre-packaged prepared food items, pre-packaged food items and soft drinks in these two (2) designated locations in Woodlawn Lake Park shall make application to the Department of Parks and Recreation. Permits will be issued for no more than a three-month period. When more than two (2) applications are received for use of these two (2) locations, a lottery will be held by the department of parks and recreation to select the approved vendors for the next three-month period. Approved vendors shall be required to pay a two hundred twenty-five dollar ($225.00) permit fee for each three-month period. The department of parks and recreation may designate one (1) additional vending location at the Woodlawn Lake Park swimming pool with use of said single location required to follow all of the provisions set out above.

The director of parks and recreation shall have authority to institute approved vendor licensing programs in other city parks outside of the downtown central business district with similar terms, conditions and restrictions as contained in subsection (7) and shall be authorized to charge a fee of two hundred twenty-five dollar ($225.00) permit fee for each three-month period.

(b)

The tax assessor-collector shall, when issuing the appropriate license provide with said license an instruction list outlining the above described restrictions.

Sec. 22-3. - Glass beverage containers prohibited in certain parks.

(a)

It shall be unlawful for any person to carry on to or to possess within any city parks any glass beverage container, unless specifically exempted from this restriction by city ordinance.

(b)

The following parks shall be exempted from the restriction in subsection (a), as well as all indoor park facilities:

(1)

S.A. Zoo in Brackenridge Park;

(2)

Witte Museum in Brackenridge Park;

(3)

HemisFair Park;

(4)

Tower of the Americas;

(5)

La Villita;

(6)

Sec. 22-4. - Use of park roads by heavy vehicles.

(a)

Purpose. The purpose of this section is the protection of park roads, designed primarily for private passenger automobile traffic carrying passengers into and out of the public parks of the city for recreational purposes from the damaging and deteriorating effects of heavy, through vehicular traffic.

(b)

Maximum weight. All use of park roads by trucks having a combined body and weight load in excess of seven thousand five hundred (7,500) pounds is prohibited.

(c)

Exceptions. This section shall not prohibit upon the park roads:

(1)

The operation of emergency vehicles;

(2)

The operation of trucks owned or operated by the city; by public utilities, by any contractor or materialman, while engaged in repair, maintenance or construction of park roads, or utilities within the park;

(3)

The operation of any truck serving a park function or performing a service for a concessionaire within a park.

Sec. 22-4.1. - Motor vehicles in city parks.

(a)

It shall be unlawful for a person to drive any motor vehicle, motorcycle, motorbike, motor scooter, or other motor-driven device or vehicle into, along or across any public park, park property, public playground or park creekway which is owned, operated or maintained by the city, except upon public roadways, designated multi-use trails and parking areas maintained by the city for the operation of such vehicles; no such vehicle shall be driven upon any trail located therein, nor shall any such vehicle be driven on a footbridge spanning a creek, driveway or stream located therein.

(b)

It shall be an affirmative defense to any charge that the vehicle driven by the defendant was a motorized wheelchair or other necessary walking aid; a vehicle being used for the purpose of construction, maintenance or repair of said parks or playgrounds; or an authorized emergency response vehicle.

(c)

It shall be an affirmative defense to any charge that the defendant has received written permission from director of the parks and recreation department to drive a vehicle outside of designated areas. The director of the parks and recreation department shall consider damage to parkland, noise, safety and the general welfare of park patrons and the public in making his determination to approve or disapprove the request.

(d)

Any person violating the provisions of this section shall be guilty of a class C misdemeanor.

Sec. 22-5. - Parking of vehicles in city parks.

It shall be unlawful for any person to park, or cause to be parked, any type of vehicle in any city park, on bridle trails, on the grass, or picnic areas, inside enclosures or in any area where such parking is prohibited by posted signs, painted stripes or red curbing. Parking of vehicles shall be permitted only in certain areas designated by appropriate signs.

Sec. 22-6. - Speed limits in city parks.

It shall be unlawful for any person to drive or operate any type of motor vehicle in any city park at a speed greater than indicated by appropriate traffic signs and in no event shall such speed exceed thirty (30) miles per hour.

Sec. 22-6.1. - Park facility promotional rates and fees.

Director of parks and recreation department is authorized to approve special promotions, rates and fees for parks and recreation facilities that are designed to market and maximize utilization of these facilities.

Sec. 22-7. - Charges for use of baseball, softball diamonds, gymnasiums.

The following fees shall be collected by the director of parks and recreation department for the rental of the following city facilities:

(1)

Baseball diamonds:

a.

Twelve dollars ($12.00) per hour before 5:00 p.m.

b.

Sixteen dollars ($16.00) per hour after 5:00 p.m.

c.

Event or tournament rental: One hundred sixty-five dollars ($165.00) for the first twelve (12) hours of use, and twenty dollars ($20.00) per hour for each additional hour (or portion of hour) of use thereafter.

d.

Organized sports league rentals: Twenty dollars ($20.00) per hour with a five hundred dollar ($500.00) deposit to cover damages and clean up.

(2)

Softball diamonds:

a.

Before 5:00 p.m.:

Youth: Ten dollars ($10.00) per hour.

Adult: Twelve dollars ($12.00) per hour.

b.

After 5:00 p.m.:

Youth: Fourteen dollars ($14.00) per hour.

Adult: Sixteen dollars ($16.00) per hour.

c.

Organized sports league rentals: Twenty dollars ($20.00) per hour with a five hundred dollar ($500.00) deposit to cover damages and clean up.

d.

Class A fields daily rental:

1.

Youth: One hundred ninety dollars ($190.00) for the first twelve (12) hours of use, and twenty dollars ($20.00) per hour for each additional hour (or portion of hour) of use thereafter.

2.

Adult: Two hundred five dollars ($205.00) for the first twelve (12) hours of use, and twenty dollars ($20.00) per hour for each additional hour (or portion of hour) of use thereafter.

3.

Class A fields include Alva Jo. Fisher Complex, Kennedy Complex, and the Koger Stokes Complex. The director of parks and recreation may designate new fields as class A or re-designate existing fields as class A as conditions may dictate.

e.

Class B fields daily rental:

Event or tournament rental: One hundred sixty-five dollars ($165.00) for the first twelve (12) hours of use, and twenty ($20.00) per hour for each additional hour (or portion of hour) of use thereafter.

(3)

Gymnasium permits:

a.

Gym practice or game use, (no admission or entry fees may be charged), twenty-five dollars ($25.00) per hour with a two-hour minimum;

b.

Special events use, seventy-five dollars ($75.00) per hour with a two-hour minimum; if food is to be served or purveyed during the event a five hundred dollar ($500.00) damage/clean up deposit will be paid prior to a permit being issued for this event to be returned less any costs encountered by city in repairing damage or cleaning after the event.

Sec. 22-8. - Party facilities rental fees.

(1)

Olmos Party House: One hundred dollars ($100.00) for four (4) hours and thirty dollars ($30.00) for each additional hour.

(2)

Woodlawn Lake Island House: One hundred dollars ($100.00) for four (4) hours and thirty dollars ($30.00) for each additional hour.

(3)

Community event facility reservation fee: One hundred fifty dollars ($150.00) for four (4) hours and thirty dollars ($30.00) for each additional hour.

(4)

A damage/cleanup deposit of one hundred dollars ($100.00) is hereby authorized to be collected at the time reservation for aforesaid facilities is made. Said damage/cleanup is refundable to the user in whole or in part based on the condition rented premises are in after a reserved event. The amount of damage/cleanup deposit refunded to the user shall be determined by the director of parks and recreation or his designee and shall be based on policies established for each facility.

(5)

Pursuant to Ordinance 63005, of June 4, 1986, the Woodlawn Lake Community Association and Church's Fried Chicken, Inc., may henceforth use the Woodlawn Lake Island House without payment of established use fees; such free use being limited to official association functions and official company-sponsored events.

Sec. 22-9. - Fees for admission and use of Spanish Governor's Palace.

(a)

Rates and policies for admission and use of the Spanish Governor's Palace will be determined by the department director in accordance with the budget ordinance.

(b)

Children enrolled in elementary and middle school grades in the San Antonio Metropolitan Area, along with accompanying adult guide(s) and supervisor(s) shall be admitted free when their admission is associated with formal and regularly scheduled educational tours sponsored by their respective school(s) or by a chartered, not-for-profit organization. The department director shall ascertain whether such tours are a part of a sustained regular or annual educational program by such schools or organizations. One-time tours shall not qualify for free admission but may qualify for reduced rates as determined by the department director.

Sec. 22-10. - Fee for use of park pavilions.

(a)

A reservation use fee of fifty dollars ($50.00) for the first four (4) hours and thirty dollars ($30.00) per hour for each additional hour on Monday through Thursday; and one hundred dollars ($100.00) for the first four (4) hours and thirty dollars ($30.00) per hour for each additional hour on Friday, Saturday, Sunday and holidays for park pavilions is hereby authorized. Users may reschedule use of the pavilion one (1) time with no charge by giving a minimum of thirty (30) days notice. One-half (½) of the reservation use fee will be refunded if use of the pavilion is canceled prior to thirty (30) days of the scheduled use. No refunds will be made if less than thirty (30) days notice of cancellation is given.

(b)

Koehler picnic area and pavilion reservation fees are as follows:

(1)

Monday through Thursday before 5:00 p.m.: Seventy dollars ($70.00) for the first four (4) hours and thirty dollars ($30.00) per hour for each additional hour.

(2)

Monday through Thursday after 5:00 p.m.: One hundred twenty dollars ($120.00) for the first four (4) hours and thirty dollars ($30.00) per hour for each additional hour.

(3)

Friday through Sunday or holidays: One hundred twenty dollars ($120.00) for the first four (4) hours and thirty dollars ($30.00) per hour for each additional hour.

(c)

Graff Pavilion reservation fees are as follows:

(1)

Monday through Thursday 8:00 a.m. to 5:00 p.m .....$70.00

(2)

Monday through Thursday after 5:00 p.m .....120.00

(3)

Friday, Saturday, Sunday and Holidays, anytime .....120.00

(4)

Organized special events, anytime .....150.00

(5)

Youth, senior and school groups, anytime .....60.00

Additional per use fee of the kitchen area in connection with any reservation, anytime .....90.00

(d)

Cypress Pavilion reservation fees are as follows:

(1)

Monday through Thursday before 5:00 p.m.: Fifty dollars ($50.00) for the first four (4) hours and thirty dollars ($30.00) per hour for each additional hour.

(2)

Monday through Thursday after 5:00 p.m.: One hundred dollars ($100.00) for the first four (4) hours and thirty dollars ($30.00) per hour additional hour.

(3)

Friday through Sunday or holidays: One hundred dollars ($100.00) for the first four (4) hours and thirty dollars ($30.00) per hour additional hour.

Sec. 22-11. - Fee for use of Mateo Camargo Park.

(a)

Fees for use of Mateo Camargo Park shall be as follows:

(1)

Attendance four hundred (400) or less: $375.00

(2)

Attendance four hundred and one (401) to one thousand (1,000): $700.00

(3)

Attendance one thousand and one (1,001) or more: $1,100.00

(4)

Pavilion only: $275.00

(b)

Non-profit organization rental rate:

(1)

Attendance four hundred (400) or less: $250.00

(2)

Attendance four hundred and one (401) to one thousand (1,000): $500.00

(3)

Attendance one thousand and one (1,001) or more: $800.00

(c)

Damage/cleanup fees for Mateo Camargo Park shall be as follows:

(1)

Attendance four hundred (400) or less: $500.00

(2)

Attendance four hundred and one (401) to one thousand (1,000): $800.00

(3)

Sec. 22-12. - Fee for use of Rosedale Park mass picnic facility.

(a)

Fees for the use of Rosedale Park mass picnic facility shall be as follows:

(1)

Attendance four hundred (400) or less: $575.00

(2)

Attendance four hundred and one (401) to one thousand (1,000): $1,100.00

(3)

Attendance one thousand and one (1,001) or more: $1,700.00

(4)

Pavilion only: $275.00

(b)

Sec. 22-13. - Admission fees for San Antonio Natatorium.

(a)

The parks and recreation department is hereby authorized to charge the fees set by the following schedule for admission to San Antonio Natatorium.

(1)

Persons under the age of eighteen (18) years .....$1.00

(2)

Persons aged eighteen (18) to fifty-nine (59) years .....3.00

(3)

Persons aged sixty (60) years and over .....2.00

(b)

The parks and recreation department is hereby authorized to charge the following special group rates for use of the San Antonio Natatorium:

(1)

Special group rate, nonexclusive, two-hour minimum, per hour .....$ 20.00

(2)

Special group rate, exclusive use, two-hour minimum, per hour .....30.00

(3)

Special group rate, exclusive use, eight-hour minimum, per day .....200.00

(4)

A group rate damage/cleanup deposit of five hundred dollars ($500.00) is hereby authorized to be collected at the time reservation for aforesaid facilities is made. Said damage/cleanup deposit is refundable to the user in whole or in part based on the condition rented premises are in after a reserved event. The amount of damage/cleanup deposit refunded to the user shall be determined by the director of parks and recreation or his designee and shall be based on policies established for each facility.

(c)

When the San Antonio Natatorium is rented by a group under terms of above established group rates, any admission fees charged by the group must be coordinated with and approved by the director, parks and recreation.

(d)

The admission fees established in subsections (a) and (b) pertain to general public admissions. Incidental use of the San Antonio Natatorium by the San Antonio Independent School District shall be pursuant to the agreement between the city and SAISD manifested by Ordinance No. 50030, November 2, 1978, which is adopted by reference as if set forth herein at length.

(e)

(1)

Individuals enrolled in group swim and group water aerobics sessions offered by the city shall pay a fee of thirty dollars ($30.00) per session.

(2)

Individuals enrolled in private swim session shall pay a fee of thirty-five dollars ($35.00) for four (4) 30-minute lessons.

(f)

Individuals requiring swimming exercises as a part of a health care provider directed therapeutic program may apply for no charge admission to the San Antonio Natatorium. Said application must be accompanied by a written confirmation of the need for therapeutic swimming exercise, and the duration of this need, by the health care provider and be for a specifically named individual. Upon review of said application and documentation, city parks and recreation staff may issue a permit for no charge admission to the San Antonio Natatorium for the duration of the certified need. Admission will be for swim times open to the general public only, and the city shall provide no other services beyond admission to the San Antonio Natatorium.

(g)

Adults (age eighteen (18) to fifty-nine (59) years) may purchase an adult swim pass good for twenty (20) admissions to the San Antonio Natatorium for fifty dollars ($50.00). The adult swim pass must be used within ninety (90) days of issuance and will expire ninety (90) days after the date of issuance regardless of the number of admissions utilized.

Sec. 22-15. - Use fee for wedding ceremonies.

Use fees may be assessed by the director of downtown operations for individual wedding ceremonies held on properties in the downtown central business district approved by the director of downtown operations.

Sec. 22-16. - Adult athletic participation fee.

(a)

An adult athletic participation fee of eleven dollars ($11.00) per individual participant in adult athletic programs is hereby authorized.

(b)

Sec. 22-17. - Park usage fee for special events.

(a)

Permit fees shall be assessed for the use of downtown parks for special events to include any commercial for-profit, commercial non-profit, non-commercial, civic, ceremonial, or other types of special event at rates to be established by the director of downtown operations.

(1)

Commercial/for-profit use shall include any sales, catered events, fairs, shows etc.

(2)

Commercial use by nonprofit organizations, to include any sales, catered events, fairs, shows, etc., events will only be certified as nonprofit if a minimum of fifty (50) percent of the gross proceeds of the events go directly to a federally designated 501c3 nonprofit organization.

(3)

Noncommercial use shall be limited to events for which no sales are permitted or donations accepted.

(4)

For special events sponsored or co-sponsored by the city, no fees for such use.

(5)

For film or photo production use, two hundred dollars ($200.00) for the first four (4) hours of use, and forty dollars ($40.00) for each additional hour or part thereof of use in any 24-hour period.

All reservations for special events in Alamo Plaza will be on first-come, first-serve basis. Reservations for any year will not be taken before January first of that year. When Alamo Plaza special event reservations are received for the same date and time, a lottery will be held by the department of downtown operations to confirm the reservation.

Alamo Plaza East may not be reserved for any commercial use. Amplified sound is not permitted in Alamo Plaza, except for ceremonial or civic events, with the prior written approval of the director of downtown operations. Commercial use of Alamo Plaza shall be limited to no more than two (2) events per month.

(b)

A park usage fee for special events within city parks shall be charged per day per event. These fees are as follows:

(1)

Small events with minimum set up requirements:

a.

Family events .....$50.00

b.

Organization/company events .....75.00

(2)

Larger events with set up or special activities:

a.

Sec. 22-19. - Fees for use of Sunken Gardens Theater.

The rental fees for use of the Sunken Gardens Theater shall be:

(1)

Attendance to any event in the Sunken Garden Theater will be strictly limited to no more than four thousand eight hundred (4,800) individuals per event. Facility renters will not allow more than four thousand eight hundred (4,800) individuals to attend any event in this facility. Any facility renter who allows attendance more than the maximum of four thousand eight hundred (4,800) per event will have their event canceled and will be precluded from rental or use of this facility in the future.

(2)

Commercial events for which admission is charged will pay fifteen (15) percent of all gross sales by the facility renter, to include but not limited to admission fees, merchandise, food and beverage concession sales and booth rentals, up to a maximum of six thousand dollars ($6,000.00) per event. The facility renter will pay a minimum of three thousand dollars ($3,000.00) per event regardless of gross sales.

(3)

Commercial events by non-profit organizations for which admission fees are charged will pay ten (10) percent of the of all gross sales by the facility renter, to include but not limited to admission fees, merchandise, food and beverage concession sales and booth rentals, up to a maximum of three thousand dollars ($3,000.00) per event. The facility renter will pay a minimum of one thousand five hundred dollars ($1,500.00) per event regardless of gross sales. Events will only be certified as non-profit for use of the Sunken Garden Theater if a minimum of fifty (50) percent of the gross proceeds of the events go directly to a federally designated 501c3 non-profit organization.

(4)

Events for which no admission is charged will pay will pay ten (10) percent of the of all gross sales by the facility renter, to include but not limited to merchandise, food and beverage concession sales and booth rentals, up to a maximum of one thousand five hundred dollars ($1,500.00) per event. The facility renter will pay a minimum of five hundred dollars ($500.00) per event regardless of gross sales.

(5)

Events sponsored or cosponsored by the city to which a donation may or may not be solicited will pay no rental fee for the use of the Sunken Garden Theater, providing however, the reserving department, agency or entity will be required to pay all direct costs associated with this use including but not limited to preparation of facility, clean-up of facility after event, costs associated with the use of the adjacent Valero Parking garage, portable toilet services and security. Failure to pay these costs will preclude that department, agency or entity from utilizing the Sunken Garden Theater in the future on a "no rental fee" basis until such time as these costs have been paid for.

All events shall pay a damage/clean-up deposit of one thousand five hundred dollars ($1,500.00).

Sec. 22-20. - Fees for use of football, soccer or rugby fields.

The following fees shall be collected by the director of parks and recreation department for rental of football, soccer or rugby fields:

(1)

Twelve dollars ($12.00) per hour before 5:00 p.m.

(2)

Sixteen dollars ($16.00) per hour after 5:00 p.m.

(3)

Event or tournament rental: One hundred sixty-five dollars ($165.00) for the first twelve (12) hours of use, and twenty ($20.00) per hour for each additional hour (or portion of hour) of use thereafter.

(4)

Organized sports league rentals: Twenty dollars ($20.00) per hour with a five hundred dollar ($500.00) deposit to cover damages and clean up.

Sec. 22-21. - Criteria for establishing fees for recreation related classes.

The department of parks and recreation is hereby authorized to charge a fee for specialized recreation related classes, programs or activities and such fees and costs will be set based on the following criteria:

(1)

The fee shall be equal to the direct and indirect cost of the classes, programs or activities as determined by the director of parks and recreation.

(2)

The cost determination shall include, but not be limited to, professional service fees paid to specialist instructors, materials used in connection with a special class or activity and other direct and indirect costs incurred in providing the program.

(3)

The total cost of a specialized service or program shall be divided equally among the registered participants in the program.

The fee for cultural based instructional classes shall be sixty dollars ($60.00) per adult (age eighteen (18) to fifty-nine (59)) per participant per class; thirty dollars ($30.00) per youth and persons age sixty (60) and over, per participant per class; fifteen dollars ($15.00) per youth each additional class, same youth; and, twenty-five dollars ($25.00) for each additional youth family member.

Sec. 22-23.2. - La Villita temporary vending permit.

The director of parks and recreation will establish policies and procedures for a working artist program to allow local, working artists to demonstrate and sell unique, hand made products in designated areas within La Villita. Permit fees shall be as follows:

(1)

Working artist program daily rate: $25.00.

(2)

Working artist program monthly rate: $300.00.

Sec. 22-24. - Fees for use of Eisenhower Park picnic facilities.

(a)

Fees for the use of Eisenhower Park mass picnic facility shall be as follows:

(1)

Attendance four hundred (400) or less: $575.00

(2)

Attendance four hundred and one (401) to one thousand (1,000): 1,100.00

(3)

Attendance one thousand and one (1,001) or more: 1,700.00

(4)

Pavilion only: 275.00

(b)

Non-profit organization rental rate:

(1)

Attendance four hundred (400) or less: $450.00

(2)

Attendance four hundred and one (401) to one thousand (1,000): 850.00

Damage/cleanup fees for the use of Eisenhower Park mass picnic facility shall be as follows:

Users may reschedule use of Eisenhower Park picnic facilities one (1) time with no charge by giving a minimum of thirty (30) days notice. One-half (½) of the reservation use fee will be refunded if use of the park is canceled prior to thirty (30) days of the scheduled use. No refunds will be made if less than thirty (30) days notice of cancellation is given.

Sec. 22-25. - Overnight camping fees.

(a)

It is unlawful to camp in city park areas unless by permit in designated areas and only by reservation or during a holiday declaration allowed for by subsection 22-28(a).

(b)

Appropriate use and reservation policies for overnight camping will be at the discretion of the director of parks and recreation.

(c)

Fees for overnight camping in parks with approved, designated camping facilities shall be as follows:

(1)

One night rental shall be from 3:00 p.m. on day of reservation until noon the following day.

Consecutive night rentals shall be from 3:00 p.m. of first day to noon of last day.

(2)

One night: Twenty dollars ($20.00).

(d)

Any person violating the provisions of this section shall be guilty of a class C misdemeanor.

Sec. 22-25.1. - Fires and fire hazards—Smoking, campfires and cooking fires.

(a)

It shall be unlawful to have a fire except in designated fire pits, fire rings, and barbeque pits.

(b)

Smoking shall be prohibited in parks designated as natural areas by the director of parks and recreation and parks developed as part of the Linear Creekway Parks development program (Leon Creek, Salado Creek, Medina River), except in areas located within these parks designated as smoking areas. "Smoking" shall mean inhaling, exhaling, burning, or carrying any lighted cigar, cigarette, pipe, weed, plant, or other combustible substance in any manner or in any form.

(c)

It shall be unlawful to collect firewood, except kindling, in city park areas.

(d)

It shall be unlawful to utilize a portable barbeque pit, grill or similar device in parks that are designated as natural areas by the director of parks and recreation with the following exceptions:

Portable, compressed-fuel camping or backpack stoves may be used in natural areas only in designated camping sites and only if user of such cooking stove has reserved the camping site. Burning of wood, charcoal and artificial logs is prohibited in such camping sites.

(e)

The director of parks and recreation department may declare an area as "extreme fire hazard" and all fires and smoking will be prohibited without exception until such designation is removed. It is understood that this declaration may precede such designation by the fire department.

(f)

Any person violating the provisions of this section shall be guilty of a class C misdemeanor.

Sec. 22-26. - Prohibiting the use of bicycles, skates, skateboards, rollerblades, in public parks except for in designated areas.

(a)

It shall be unlawful to drive, ride or use bicycles, skates, skateboards, or rollerblades in any city park except:

(1)

On those trails approved for such use as designated by the director of the parks and recreation department or the director of the downtown operations department for all downtown parks administered by the downtown operations department;

(2)

On park roads; or

(3)

On designated park equipment.

(b)

It shall be an affirmative defense to any charge that a bicycle used was by a child riding a tricycle or bicycle with training wheels under immediate adult supervision.

(c)

Any person violating the provisions of this section shall be guilty of a class C misdemeanor.

Sec. 22-26.1. - Trails.

(a)

The director of the parks and recreation department or the director of the downtown operations department for all downtown parks administered by the downtown operations department, shall have the authority to specify use categories for trails, which shall be determined by park location, park conditions, and size and/or construction material(s) of trails. Each trail within a city park will be designated into an appropriate use category. All park trails shall be determined to be pedestrian trails unless specifically designated as another category.

(b)

The following trail designations shall utilized:

(1)

Nature trails shall be utilized for walking or hiking. Bicycles, skateboards, rollerblades, motorized or non-motorized vehicles are prohibited.

(2)

Pedestrian trails shall be utilized for walking, hiking or jogging. Bicycles, skateboards, rollerblades, motorized or non-motorized vehicles are prohibited. The exception of children on tricycles or on bicycles with training wheels may be allowed, as long as they are utilized under immediate adult supervision.

(3)

Bicycle trails shall be utilized for biking. Walking, hiking, jogging, skateboards, rollerblades, motorized or non-motorized vehicles are prohibited.

(4)

Multi-use trails shall be utilized for a combination of activities including but not limited to walking, hiking, jogging, biking and skating, as specifically designated. Bicycles and skaters will give right-of-way to walkers. Some limited motorized equipment may be allowed in certain designated areas and within parameters determined by the director of parks and recreation. Any such allowed equipment shall give right-of-way to all other users.

(c)

It shall be unlawful to utilize a trail in violation of its designated use determined by the director of the parks and recreation department or the director of the downtown operations department.

(d)

It shall be unlawful for any person to enter a naturally vegetated area in a city park not designated for public access.

(e)

It shall be unlawful to bring horses onto any city trails unless the director of the parks and recreation department has designated the trail for horse riding.

(f)

It shall be an affirmative defense to any charge that the person was an employee or official of the city performing maintenance, security or monitoring activities.

(g)

Any person violating the provisions of this section shall be guilty of a class C misdemeanor.

Sec. 22-27. - Daily rental rates for the Arneson River Theater.

The following daily rental rates for the Arneson River Theater are hereby established:

(1)

Non-commercial rate: Two hundred fifty dollars ($250.00) per hour, fifty dollars ($50.00) per additional hour plus five hundred dollars ($500.00) security deposit.

(2)

Commercial rate: $500.00/per hour, then $100.00/additional hour plus $500.00 security deposit.

Sec. 22-28. - Public parks hours of operation and curfew.

(a)

All public parks owned or operated by the city, except for the River Walk, Alamo Plaza, La Villita, Market Square, Woodlawn Lake Park and HemisFair Park shall be closed for all purposes at 11:00 p.m. each day and re-opened for public use at 5:00 a.m. each day. Public parks may be utilized for special events and/or holiday use between the hours of 11:00 p.m. and 5:00 a.m. on any day with the prior written approval of the director of the department of parks and recreation ("director") through the issuance of a special events permit or holiday declaration. A holiday declaration by the director shall have the effect of lifting the curfew for those parks specified by the director during those time periods specified by the director. The department of parks and recreation shall develop written guidelines for the issuance of special events permits. At a minimum, the department of parks and recreation shall have authority to reject any and all applications on the basis of protecting the health and safety of the public and the foregoing guidelines shall include such authority. Said written guidelines may include limitations on the types of special uses, noise limitations, maintenance requirements, limitations on the frequency with which any individual, group, association or entity shall be granted such special use permits and any other restrictions deemed appropriate by the department of parks and recreation. The curfew set forth in this section will not apply to organized programs and activities in public parks and parks facilities staffed, sponsored or co-sponsored by the department of parks and recreation. It is an affirmative defense to prosecution that during those hours prohibited by this section there occurred an official use or event by an organization which has entered into a lease or license agreement with the city specifically authorizing such use of such specific area in the public park. The department of parks and recreation shall have authority to set more restrictive hours of operation for individual parks and facilities on a case by case basis but not to change the hours of the curfew violations as defined by this section.

(b)

It shall be unlawful for a person to be in or on a public park in violation of this section.

(c)

If an events permit has been issued to a person in accordance with subsection (a) hereof, it shall be unlawful for such person to be in or on a public park in violation of any condition or limitation set forth in such events permit.

(d)

Notwithstanding subsection (a), Comanche Lookout Park shall be closed for all purposes each day thirty (30) minutes after sunset, or after events scheduled by the department of parks and recreation are completed, and will re-open each day at sunrise.

(e)

Notwithstanding subsection (a), parks designated as natural areas by the director of parks and recreation and parks developed as part of the Linear Creekway Parks development program (Leon Creek, Salado Creek, Medina River) shall be closed for all purposes each day at sunset, or after events scheduled by the department of parks and recreation are completed, and will re-open each day at sunrise.

(f)

Any person violating the provisions of this section shall be guilty of a class C misdemeanor.

(g)

Any vehicle left parked after the curfew hours established above shall be subject to towing.

Sec. 22-30. - Special facilities use fees for HemisFair Park and Alamo Plaza.

The parks and recreation department is hereby authorized to charge the following use fees for facilities at HemisFair Park and Alamo Plaza for special major events:

(1)

Hemisfair Park:

Use by non-profit agencies/organizations: .....$2,000.00

Use by commercial agencies/organizations: .....4,000.00

(2)

Alamo Plaza:

Use by non-profit agencies/organizations: .....2,000.00

(3)

Damage and clean-up deposit: A deposit of five thousand dollars ($5,000.00) for commercial agencies/organizations or two thousand dollars ($2,000.00) for non-profit agencies/organizations shall be required for each special major event reservation, with said deposit to be returned if damage does not occur and if cleanup by the user is deemed to be satisfactory by the director, department of downtown operations, or his/her designee.

Sec. 22-31. - La Villita McAllister Building use fees.

A use fee of three hundred dollars ($300.00) per event with a five hundred dollar ($500.00) security deposit for La Villita McAllister Building is hereby approved.

Sec. 22-32. - Community centers, senior centers and clubhouse rental fees.

Community centers, senior centers and clubhouse reservation use permits. Use of the department of parks and recreation's community centers, senior centers and clubhouses for meetings, special events, or other occasional purposes by the public, either after regular facility hours, or when not in use for city programs will require the payment of the following fees and deposits:

(1)

Gym only practice or games use, (no admission or entry fees may be charged), twenty-five dollars ($25.00) per hour with a two-hour minimum.

(2)

Gym only or meeting room only, general use (no admission or entry fees may be charged), fifty dollars ($50.00) per hour with a two-hour minimum; if food is to be served during the use a one hundred dollar ($100.00) damage/clean up deposit will be paid prior to a permit being issued for this use, deposit to be returned, less any expenses encountered by city for cleaning or damage.

(3)

Gym only or meeting room only, special events use, seventy-five dollars ($75.00) per hour with a two-hour minimum; if food is to be served or purveyed during the event a five hundred dollar ($500.00) damage/cleanup deposit will be paid prior to a permit being issued for this event, deposit to be returned, less any expenses encountered by city for cleaning or damage.

(4)

Notwithstanding the preceding, neighborhood associations and community organizations registered with the neighborhood and urban design division of the city's planning department will be charged only a fifty dollar ($50.00) deposit prior to the use of the facility for normal operating hours only. The fifty dollar ($50.00) deposit shall be returned to the association after the event if the community center, senior center or clubhouse is cleaned by the association or organization after their use and there is no damage to the facility. Notwithstanding the proceeding, rentals by these organizations after normal operating hours will be charged the hourly fees designated in subsections (1)—(3) above.

Sec. 22-34. - Commercial filming and movie production permit.

A permit is required for commercial filming and/or movie production activity in any city park, the River Walk, or Alamo Plaza. Applications for such filming or movie production activity shall be submitted to the San Antonio Film Commission in the city's convention and visitor's bureau. Fees for issuance of the commercial filming and movie production permit shall be as follows:

Sec. 22-35.1. - San Antonio convention facilities rental rates.
