Sec. 25-41. - Sale at public auction of certain property held by police for four months.
All abandoned, stolen or recovered property of any kind, except motor vehicles, which shall remain unclaimed with the police department for a period of four (4) months without being claimed or reclaimed by the owners, whether known or not, may be sold and disposed of at public auction, as provided in this article.

Sec. 25-42. - Notice of sale; sale to highest bidder.
Thirty (30) days notice of the time and place of sale of all abandoned, stolen or recovered property, except bicycles, and in the case of bicycles, fifteen (15) days notice of the time and place of sale and a descriptive list of the property and bicycles to be offered for sale shall be posted at the door of the county courthouse and on the bulletin board located in the city hall lobby and a copy thereof shall be sent by certified mail to the last known address of the owner, in the event the name of the owner is known to the police chief. Thereafter, the property shall be offered for sale at public auction to the highest bidder for each piece of property or bicycle, or assembled in lots, whichever, in the discretion of the police chief, shall offer the best price obtainable for such property or vehicles.

Sec. 25-43. - Sale; bill of sale; persons prohibited from bidding.
The public auction provided for in section 25-16 shall be conducted at the place and hour designated in the notice and all sales shall be for cash. Said property shall be sold as is, and a bill of sale, if requested, shall be given to the purchaser but no title transfer or title papers of any nature shall be furnished. City employees or members of their immediate families shall not be permitted to bid on any of the above items and no person that is delinquent in the payment of city property taxes shall be permitted to bid on any of the above items nor shall any sale of said items be made to such person.

Sec. 25-44. - Record of sale; accounting for proceeds of sale.
Within five (5) days after any such sale has been completed, the chief of police shall make a record thereof, under oath, to the controller of the city and shall account for the money received at all such sales in the same manner as is prescribed for him to account for all other monies that may come into his custody as chief of police.
