DIVISION 2. - SPECIFIC PARKING REGULATIONS [83]


Sec. 19-191. - Application of article.

The provisions of this division prohibiting the standing or parking of a vehicle shall apply at all times or at those times herein specified or as indicated on official signs except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic-control device.

Sec. 19-192. - Regulations not exclusive.

The provisions of this article imposing a time limit on parking shall not relieve any person from the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing, or parking of vehicles in specified places or at specified times.

Sec. 19-193. - Parking prohibited at all times on certain streets.

When signs are erected giving notice thereof, no person shall park a vehicle at any time upon any of the streets designated as "no parking zones" by separate ordinance of the city.

Sec. 19-194. - Parking of certain vehicles prohibited on certain streets, and parking of certain motor vehicles prohibited on front lawns of residential zones.

(a)

It shall be unlawful for any person owning or having control of any oversized vehicle as defined in chapter 35 of this Code, to park the same in front of any lot or parcel used solely for a residential use (to include home occupations) within a special district, as defined in chapter 35 of this Code, or zoned FR, RD, or UD or upon any street within the following residential zoning districts: FR, R-3, R-4, R-5, R-6, R-20, RM-4, RM-5, RM-6, NP-8, NP-10, NP-15, MH, MF-25, MF-33, MF-40, MF-50, or residential PUD or other planned residential districts, according to the zoning provisions of the city (chapter 35) at all times. This section shall not apply to the parking of such vehicles for such time as is actually necessary to load or unload passengers, freight or merchandise.

(b)

No oversized vehicle of any type shall be parked at any time within the restricted parking area as defined in chapter 35 in any of the residential districts as listed in subsection (a) above, provided, however, this section shall not apply to the parking of such vehicles for such time as is actually necessary to load or unload passengers, freight or merchandise, or if the oversized vehicle bears a valid special handicapped parking permit as allowed in section 35-385 of this Code. In addition, an oversized vehicle, other than one that is also defined as a truck-tractor, road-tractor, semi-trailer, trailer or commercial motor vehicle with three (3) or more axles, may be parked within the restricted parking area for such time as is actually necessary for trip preparation as allowed in section 35-385 of this Code.

(c)

In this section, the terms truck-tractor, road-tractor, semitrailer, trailer, and commercial motor vehicle shall not mean nor include a recreational vehicle.

(d)

It shall be unlawful for any person owning or having control of a motor vehicle, water craft, non-motorized camper, or any trailer designed to be pulled by a motor vehicle and/or to carry a watercraft, camper or motor vehicle to park or allow same to be parked at any time in the side yard setback or front yard, as defined in chapter 35 of this Code, or in any area between the property line of the lot and the curb line or the edge of the adjacent street within any of the residential districts as listed in subsection (a); provided, however, that motor vehicles, watercrafts on trailers, campers and other trailers may be parked only on the side yard set back or front yard with all wheels on permanently maintained parking areas constructed of:

(1)

Gravel with barriers or permanent curbing to define the driveway;

(2)

Concrete;

(3)

Brick; or

(4)

Asphalt;

extending from the curb, street, or alley in a contiguous course, and only where such parking areas are no wider than the width established by subsection (e). Recreational vehicles may be parked in accordance with the provisions of section 35-385 for the purposes of trip preparation, however nothing in this subsection shall invalidate the provisions for oversized or recreational vehicles listed in this chapter or chapter 35 of this Code nor permit the parking of such vehicles in a manner inconsistent with subsection (b) or section 35-385.

(e)

The gravel, concrete, or asphalt parking area referred to in subsection (d) shall be no wider than fifty (50) percent of the average width of the lot, except in the following situations:

(1)

The vehicle is parked at a residential building which does not meet the minimum setback requirements as set out in chapter 35; or

(2)

The vehicle is parked at a residential building where the width of the lot is twenty-five (25) feet or less; or

(3)

The vehicle is parked at a residential building abutting a street which is curbless or which is less than thirty (30) feet wide.

(4)

The specific zoning for the lot sets a maximum for such widths.

(f)

The authority to enforce the provisions of this section shall be vested in the police department and with the code compliance department.

(g)

For purposes of this section, proof that the vehicle was, at the time of the offense alleged, owned by the person charged with the offense, shall constitute prima facie evidence that the vehicle was parked or left standing at the place charged by the owner; but the owner shall have the right to introduce evidence to show that the vehicle was not parked by him as charged in the complaint.

(h)

This section shall be enforced as prescribed in section 19-225 of this Code.

Sec. 19-195. - Stopping, standing, or parking prohibited during certain hours on certain streets.

(a)

When signs are erected in each block giving notice thereof, no person shall park a vehicle during the hours specified and upon any of the streets described by separate ordinance of the city establishing such hours of parking on such streets; provided, this section shall not be applicable on Sundays or public holidays as defined under section 19-218

(b)

When signs are erected in each block of the streets as listed below giving notice thereof, no person shall park a vehicle between the hours of 7:00 a.m. and 6:00 p.m. Monday through Friday and between 7:00 a.m. and 12:00 noon on Saturdays. Public holidays as defined in section 19-218

Sec. 19-196. - Parking time limited on certain streets.

When signs are erected in each block, giving notice thereof, no person shall park a vehicle for longer than the one (1) hour or two (2) hours, whichever is designated by the signs at any time between the hours of 7:00 a.m. and 6:00 p.m. on any day except Sundays and holidays.

Sec. 19-197. - Parking time limit signs required except for decal program time limits; prohibited parking signs required.

Whenever an ordinance prohibits parking or imposes a parking time limit, except any time limit imposed by the decal program, the traffic engineer shall erect a sign giving notice thereof, and no such parking regulation shall be given effect unless such sign is erected at the time of the alleged parking violation.

Sec. 19-198. - Unauthorized parking in city owned parking lots prohibited.

(a)

It shall be unlawful for any person to stop, stand or park any vehicle at any time on any day in the following city-owned parking lots:

(1)

The parking lot located at the loading ramp area to the Theater of the Performing Arts and extending to that area between the Theater of the Performing Arts and the Hemisfair Arena (north of the Arena);

(2)

The parking lot located in that area between the Hemisfair Waterway (southeast of the Arena) and extending to the area in front of the Arena ticket office (south and southwest of the Arena);

(3)

The parking lots of the San Antonio Public Library, located at 230 South St. Mary's Street and 210 West Market Street;

(4)

The parking lot south of police headquarters (west of San Pedro Creek and east of Laredo Street);

(5)

The parking lot west of police headquarters (east of Santa Rosa Street and south of Nueva Street);

(6)

The welfare division parking lot south of Graham Alley and east of Santa Rosa Avenue.

(b)

It shall be unlawful for any person to stop, stand or park any vehicles:

(1)

Between the hours of 7:00 a.m. and 6:00 p.m. in slots 1—13 daily, and between 7:00 a.m. and 4:30 p.m. daily in all other slots, except Saturdays, Sundays, and the holidays named in section 19-218 of this chapter in the parking lot on the west side (Plaza de Armas), north and south sides, (Military Plaza) of City Hall;

(2)

Between the hours of 7:00 a.m. and 6:00 p.m. daily, except Saturdays, Sundays and the holidays named in section 19-218 of this chapter in the parking lot located on the east and west side of city hall annex (east of San Pedro Creek between Dolorosa and Nueva Streets); and

(3)

Between the hours of 7:00 a.m. and 6:00 p.m. daily except Saturdays, Sundays, and the holidays named in section 19-218 of this chapter in the parking lot located west of the Bexar County Jail (east of South Santa Rosa between West Nueva and Dolorosa Streets).

(c)

Provided, however, that subsections (a) and (b) above shall not apply to any city motor vehicle bearing exempt license plates or motor vehicles bearing properly affixed permit decals issued by the city manager parked on the lots described in subsections (b)(2) and (b)(3) above, and provided further that subsections (a) and (b) above shall not apply to any motor vehicle parked on the city hall parking lot described in subsection (b)(1) bearing properly affixed permit decals issued by the city manager or vehicles displaying a valid "disabled" tag issued to the permanently disabled persons placed in the lower left-hand side of the front windshield when these vehicles are parked in spaces designated for the disabled and otherwise parked in compliance with section 19-201

(d)

Violation of any of the provisions hereof shall be punished in accordance with section 1-5

(j)

A one-time fee reduction of twenty dollars ($20.00) is authorized to provide an incentive for monthly customers to participate in an electronic payment program.

(k)

The city manager or the manager's designee may, without further council action, offer free parking or discounts from the parking rates specified in section 19-199 when in the best interests of the city. Nonexclusive examples possibly appropriate for exercising this authority are special events held downtown by local companies and events held in San Antonio by out-of-town organizations. The city manager or the manager's designee may further offer discounts to local entities negotiating for parking for employees or other large groups. They further may, for the customers of downtown businesses making a request, match lower prices offered by private-sector parking competitors. The city manager or the manager's designee may develop policies and procedures to put this subsection into effect, including validation or similar programs, and may, without council action, terminate any agreement reached under the authority of this subsection. The city manager or the manager's designee may reduce generally all or any part of the rates in set in section 19-199 if they find the rates are so high that they reduce parking system revenue.

Sec. 19-200. - Reserved parking for certain consuls of other nations; unauthorized vehicles prohibited.

(a)

Parking space on certain portions of city streets is hereby reserved for consuls of certain nations as indicated below:

Nicaragua Adjacent to 310 South St. Mary's approximately seventy-five (75) feet north of Villita Street. Twenty (20) feet in length and on the even side of South St. Mary's.
El Salvador Adjacent to 206 West Travis approximately thirty (30) feet west of North Flores Street. Twenty (20) feet in length and on the even side of West Travis.
Honduras Adjacent to 5414 Lancashire. Thirty (30) feet in length and on the even side of Lancashire.

 

(b)

Parking in the areas described above of vehicles other than official consular vehicles or authorized emergency vehicles is hereby prohibited.

Sec. 19-201. - Parking for disabled persons; violations.

(a)

Designations. Locations which are designated by separate ordinance as parking spaces for use by vehicles used by or for the transportation of disabled individuals as defined in Vernon's Ann. Civ. St. art. 6675a-5e-1 shall be restricted to use by such disabled individuals, when such vehicles display a valid "disabled" tag issued to the permanently disabled or an identification card issued to temporarily disabled persons placed in the lower left-hand side of the front windshield provided by the state department of highways and public transportation.

(b)

Violations. It shall be unlawful and a violation of the provisions of this section for any person:

(1)

To cause, allow, permit or suffer any vehicle registered in the name of, or operated by such person to be parked in any space hereby reserved for the disabled, unless there is affixed to such a vehicle a valid "disabled" tag or a temporarily disabled person identification card placed in the lower left-hand side of the front windshield.

(2)

To cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked in any space hereby reserved for the disabled, even if such vehicle has affixed thereto a valid "disabled" tag or a temporarily disabled person identification card placed in the lower left-hand side of the front windshield, if the vehicle is not being used by or for the transportation of a disabled person.

(3)

To cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to park a vehicle so that the vehicle blocks an access or curb ramp or any other architectural improvement designed to aid the disabled.

(c)

Presumptions. Whenever any vehicle stands in a parking space reserved for the disabled, and such vehicle does not have a valid "disabled" tag affixed thereon or displaying a temporarily disabled person identification card placed in the lower left-hand side of the front windshield, such fact shall be prima facie evidence that the vehicle has been parked illegally, and that the registered owner of such vehicle did knowingly cause, allow, permit or suffer such vehicle to be parked in such location.

(d)

Penalty. Any person violating the provisions of this section shall, upon conviction, be subject to the penalty prescribed in section 1-5 of this Code.

Sec. 19-202. - Reserved parking for Bexar County sheriff personnel.

(a)

Designations. The east side of South Main between Dolorosa and Nueva Streets is hereby reserved for the parking of vehicles either belonging to the Bexar County Sheriffs Department or operated by county sheriff personnel which bear an identification sticker approved by the county sheriff affixed to the rear window.

(b)

Violations. It shall be unlawful and a violation of the provisions of this section for any person to cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked in any space hereby reserved for county sheriff personnel unless there is affixed to the rear window of such vehicle a valid identification sticker approved by the county sheriff.

(c)

Presumptions. Whenever any vehicle stands in a parking space reserved for the county sheriff personnel, and such vehicle does not have a valid identification sticker approved by the county sheriff affixed thereon such fact shall be prima facie evidence that the vehicle has been parked illegally and that the registered owner of such vehicle did knowingly cause, allow, permit or suffer such vehicle to be parked in such location.

(d)

Penalty. Any person who shall violate any provisions of this section shall be deemed guilty of a misdemeanor and shall upon conviction be punished in accordance with section 1-5

Sec. 19-203. - Reserved parking for county district court clerk personnel.

(a)

Designation. One (l) parking space on the west side of Main Plaza between Dolorosa and Villita Streets, and so designated by sign, is hereby reserved for the parking of vehicles either belonging to county district court clerk or operated by the county district court clerk personnel which has displayed on the front windshield dash an identification plaque approved by the county district court clerk.

(b)

Violations. It shall be unlawful and a violation of the provisions of this section for any person to cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked in any space hereby reserved for the county district court clerk personnel unless there is displayed on the front windshield dash of such vehicles a valid identification plaque approved by the county district court clerk.

(c)

Presumptions. Whenever any vehicle stands in a parking space reserved for the county district court clerk personnel and such vehicle does not have a valid identification plaque approved by the county district court clerk displayed therein, such fact shall be prima facie evidence that the vehicle has been parked illegally and that the registered owner of such vehicle did knowingly cause, allow, permit or suffer such vehicle to be parked in such location.

(d)

Penalty. Any person who shall violate any provisions of this section shall be deemed to be guilty of a misdemeanor and shall upon conviction be punished in accordance with section 1-5

Sec. 19-204. - Reserved parking for City of San Antonio.

(a)

Designation. The north side of Trevino Street from South Main Avenue to a point one hundred thirty-five (135) feet west of South Main Avenue is hereby reserved for the parking of vehicles either belonging to the City of San Antonio or operated by City of San Antonio personnel which has displayed on the front windshield dash an identification plaque approved by the director of the department of public works.

(b)

Violations. It should be unlawful and a violation of the provisions of this section for any person to cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked in any space hereby reserved for the city of San Antonio personnel unless there is displayed on the front windshield dash of such vehicles a valid identification plaque approved by the director of public works, or unless such vehicle is parked between the hours of 7:00 a.m. and 6:00 p.m. daily, except Saturdays, Sundays and holidays named in section 19-218 of this Code.

(c)

Presumptions. Whenever any vehicle stands in a parking space reserved for the City of San Antonio personnel and such vehicle does not have a valid identification plaque approved by the director of the public works department displayed herein, such fact shall be prima facie evidence that the vehicle has been parked illegally and that the registered owner of such vehicle did knowingly cause, allow, permit or suffer such vehicle to be parked in such location.

(d)

Penalty. Any person who shall violate any provisions of this section shall be deemed to be guilty of a misdemeanor and shall upon conviction be punished in accordance with section 1-5, Chapter 1 of the City Code.

Sec. 19-205. - Parking on rights-of-way beneath Interstate Highways 35 and 37 on certain streets prohibited.

It shall be unlawful for any person to park on the public right-of-way underneath Interstate Highway 35 between West Commerce and Buena Vista Streets, Camaron and North Flores Streets, West Houston and West Commerce Streets, and Buena Vista and Guadalupe Streets and Interstate Highway 37 between Ninth Street and Jones Avenue, Nolan and Houston Streets, Josephine and Grayson Streets, and Newell Street and Pearl Parkway between the hours of 2 a.m. and 6 a.m. or park single unit motor vehicles of size and capacity greater than prescribed for one and one-half (½) ton trucks on said public rights-of-way.

Sec. 19-206. - Reserved parking for San Antonio Police Department, Marked Patrol Vehicles Only.

(a)

Designations. The south curb lane of the 200 block of W. Neuva Street next to the police department, located between S. Laredo Street and the driveway next to San Pedro Creek.

(b)

Violations. It shall be unlawful and a violation of the provisions of this section for any person to cause, allow, permit or suffer any vehicle registered in the name of, or operated by such person to be parked in any space hereby reserved for San Antonio Police personnel unless the vehicle is a marked patrol vehicle.

(c)

Presumptions. Whenever any vehicle stands in a parking space reserved for the San Antonio Police personnel, and such vehicle is not a marked patrol vehicle such fact shall be prima facie evidence that the vehicle has been parked illegally and that the registered owner of such vehicle did knowingly cause, allow permit or suffer such vehicle to be parked in such location.

(d)

Penalty. Any person who shall violate any provision of this section shall be deemed to be guilty of a misdemeanor and shall upon conviction be punished by a fine of not less than one dollar ($1.00) nor more than two hundred dollars ($200.00).

Sec. 19-207. - Reserved parking for county officials.

(a)

Designation. Twenty-five parking spaces on the west side of Main Plaza between Dolorosa and West Nueva Streets, designated by signs, are hereby reserved for the parking of vehicles which belong to Bexar County officials and which have displayed on the front windshield dash an identification plaque signed and approved by the parking administrator of the city department of public works.

(b)

Violations. It shall be a civil violation of the provisions of this section for any person to cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked in any space hereby reserved for Bexar County officials unless there is displayed on the front windshield dash of such vehicles a valid identification plaque approved by the parking administrator of the city department of public works.

(c)

Presumption. Whenever any vehicle standing in a parking space reserved herein does not have a valid identification plaque displayed therein, such fact shall create a legal presumption that the registered owner of such vehicle did knowingly cause, allow, permit or suffer such vehicle to be parked in such location.

(d)

Penalty. Any vehicle determined to be in violation of this section shall be subject to immediate impoundment, and the violator shall be subject to a civil fine of not more than two hundred dollars ($200.00), and other enforcement measures stated in the administrative hearing officer's order.

Sec. 19-208. - Prohibited parking at Alamo East, within the Historic 1836 Alamo Fortress Compound.

Vehicular parking is hereby prohibited on Alamo East, at all times within the Historic 1836 Alamo Fortress Compound. Public tour and school bus parking, loading and unloading are likewise prohibited from this area.

Sec. 19-209. - Public tour and school bus parking for Alamo.

Public tour and school buses may park in a restricted parking area under Interstate Highway 37 south of Nolan Street while waiting to return to the Alamo to pick up tourists and students. Routes between the Alamo and the designated parking under IH 37 are shown in Exhibit III.

Sec. 19-210. - Former prisoners of war and Purple Heart recipients exempt from the payment of parking fees.

A vehicle displaying special license plates issued by the Texas State Department of Highways and Public Transportation to former prisoners of war as provided in V.T.C.A., Transportation Code § 502.257, and to Purple Heart recipients, as provided in V.T.C.A., Transportation Code § 502.260, is exempt from the payment of parking fees collected at parking garages and lots which are owned or leased by the city, or collected through parking meters charged by the city. This exemption does not allow parking a vehicle at a place or time that parking is prohibited.
