DIVISION 7. - FISCAL PROVISIONS


Sec. 29-187. - Right-of-way management fund.

[(a)]

Section 1: The director of finance is authorized to establish a project within the Miscellaneous Special Revenue—Streets & Drainage Fund 29-014002, entitled "Right-of-Way Management Street Restoration Project" to account for all revenues and expenditures to manage construction, excavation and placement of utilities; establishing fees; providing a penalty for violation by fine of not more than six hundred ($600.00) per day, per violation, and providing for publication. The director of finance is authorized to record and account for the project in accordance with Generally Accepted Accounting Principles (GAAP).

Section 2: The director of finance is authorized to establish a project within the Miscellaneous Special Revenue— Streets & Drainage Fund 29-014003, entitled "Right of Way Management Street Restoration Reserve" to account for penalties and payment repair revenues authorized. The director of finance is authorized to record and account for the project in accordance with Generally Accepted Accounting Principles (GAAP).

Section 3: Eighteen (18) new positions (one (1) Administrative Assistant II, six (6) Engineering Technicians, one (1) Fiscal Officer, three (3) Permit Clerks, one (1) Right-of-Way Manager, one (1) GIS Manager, four (4) Sr. Engineering Technicians, one (1) Utility coordinator) are hereby authorized in Fund 29-014002.

Section 4: Funds in the amount of one million one hundred thirty thousand six hundred forty-four dollars ($1,130,644.00) are appropriated in Fund 29-14002, entitled Miscellaneous Special Revenue: Streets & Drainage—Right-of-Way Management Restoration Project, as set out in Attachment I.

Section 5: The following fees authorized by this article are to be deposited in Fund 29-014002 in the index codes indicated below and budgets are authorized to be established:

Attachment I is authorized for adoption into fiscal year 2000/2001 annual budget in Fund 29-014 (Streets Maintenance Special Revenue Fund) in Project 29-014002 (Right-of-Way Management Street Restoration Project). The personnel complement and budget appropriations, for the department, contained therein is authorized.

A separate fund shall be created, effective as of the effective date of the ordinance from which this article derives, known as the Right-of-Way Management Street Restoration Fund, for the purpose of identifying and controlling all revenues and expenses attributable to the Right-of-Way Management Street Restoration Program. All right-of-way management charges collected by the city, after the effective date of the ordinance from which this article derives, and other monies city council may wish to designate for this fund, shall be deposited in the Right-of-Way Management Street Restoration Fund. Such revenues shall be used for the purposes of administration, studies, engineering, construction, reconstruction and other reasonable and customary charges associated with the operation of the Right-of-Way Management Program.

Revenue collected through Right-of-Way Management shall be recorded and accounted for in a manner that insures that said funds are expended solely for expenses accrued by the Right-of-Way Management Street Restoration Program. The balance of funds on deposit in the account at the end of any fiscal year shall remain in the account and not be absorbed into the general fund.

Sec. 29-188. - Annual report.

A report shall be made to the city council on an annual basis detailing the revenue and expenditure from the street excavation permit and associated fees collected and expended for the Right-of-Way Management Program.
