DIVISION 3. - REINVESTMENT ZONES


Sec. 31-166. - Criteria for designation.

The City of San Antonio must designate, or have already designated, an area as a reinvestment zone for TIF to occur. As provided under V.T.C.A., Tax Code § 311.005, to be designated, an area must:

(a)

Substantially arrest or impair the sound growth of the municipality creating the zone;

(b)

Retard the provision of housing accommodations;

(c)

Constitute an economic or social liability and be a menace to the public health, safety, morals, or welfare in its present condition and use because of the presence of:

1.

A substantial number of substandard, slum, deteriorated, or deteriorating structures;

2.

The predominance of defective or inadequate sidewalk and street layout;

3.

Faulty lot layout in relation to size, adequacy, accessibility, or usefulness;

4.

Unsanitary or unsafe conditions;

5.

The deterioration of site or other improvements;

6.

Tax or special assessment delinquency exceeding the fair value of the land;

7.

Defective or unusual conditions of title; or

8.

Conditions that endanger life or property by fire or other causes;

(d)

Be predominantly open and, because of obsolete platting, deterioration of site improvements, or other factors, substantially impair or arrest the sound growth of the municipality;

(e)

Be in a federally assisted new community located in the municipality or in an area immediately adjacent to a federally assisted new community ("federally assisted new community" means an area that has received or will receive assistance in the form of loan guarantees under Title X of the National Housing Act, if a portion of the federally assisted area has received grants under Section 107(a) of the Housing and Community Development Act of 1974);

(f)

Be an area described in a petition requesting that the area be designated as a reinvestment zone, if the petition is submitted to the governing body of the municipality by the owners of property constituting at least fifty (50) percent of the appraised value of the property in the area according to the most recent certified appraisal roll for Bexar County;

(g)

Be an area designated as an enterprise zone under V.T.C.A., Government Code ch. 2303, or as a defense economic readjustment zone under ch. 2310.

Sec. 31-167. - Restrictions on composition.

(a)

Size limitations. The City of San Antonio is not permitted under V.T.C.A., Tax Code § 311.006 to create a reinvestment zone or change the boundaries of an existing reinvestment zone if the total appraised value of taxable real property in the proposed zone and in existing reinvestment zones exceeds:

(1)

Fifteen (15) percent of the total appraised value of taxable real property in the City of San Antonio and industrial districts created by the City of San Antonio;

(2)

Fifteen (15) percent of the total appraised value of taxable real property of Bexar County; or

(3)

Fifteen (15) percent of the total appraised value of taxable real property of the school district that levies taxes in the proposed reinvestment zone.

Use limitation. The City of San Antonio is not permitted under V.T.C.A., Tax Code § 311.006 to create a reinvestment zone or change the boundaries of an existing reinvestment zone, if more than ten (10) percent of the property in the proposed zone (or modified zone), excluding publicly-owned property, is used for residential purposes, specifically for houses having fewer than five (5) living units.

(c)

Exception to limitations. The above use limitation does not apply if a reinvestment zone is designated following submission of a petition, as described above in subsection 31-166(f).

Sec. 31-168. - Project eligibility.

(a)

Targeted types of development and locations. It is the intention of the City of San Antonio to use TIF for the primary purpose of encouraging community revitalization within Loop IH-410 and areas south of U.S. Highway 90 by leveraging private investment for certain types of development activities. The City of San Antonio uses TIF to target the types and locations specified in section 31-116

(b)

Project status. Because of the considerable time and resources required to process TIF applications, it is the intent of the City of San Antonio to respond to applications and petitions for the creation of reinvestment zones for the purpose of TIF only if an eligible project is in the advanced stages of development planning, as evidenced by property control.
