(7) The basic source of the material in this subpart is the related laws portion (part II) of the city's 1968 Code as supplemented through March 21, 1991. (Back)
(7) In the case of a section derived exclusively from the Delaware Code, the source is indicated by a state law reference following the section stating where similar provisions are found in the Delaware Code. Such Delaware Code references are to the Delaware Code of 1974 (Del. C.) as amended through November 30, 1991 (136th General Assembly—Vol. 68 of the Delaware Laws). In the preparation of the 1991 codification no attempt has been made to compare the exact language in this part with the Delaware Code. If the legislative history did not indicate that the provisions were amended by legislation not present in the 1968 city Code and it was not readily apparent that the 1974 recodification of the Delaware Code reformatted or reworded the provisions (some of the provisions being derived from the 1953 Delaware Code), the language in the 1968 Code was treated as being accurate. (7) In the case of a section not derived exclusively from the Delaware Code, the source is stated in a history note following the section. As in the case of material derived from the Delaware Code, the language in the 1968 Code is treated as authoritative. Obvious errors in history notes have, however, been corrected. (Back)
(7) Obvious misspellings have been corrected without notation. For stylistic purposes, a uniform system of headings, catchlines and citations to state statutes (i.e., the Delaware Code) that are not part of the material being compiled has been used. In material derived from a special act, textual references to other sections of the same act have been changed to reference the appropriate section of this subpart. Additions made for clarity are indicated by brackets. In addition, the following appeared in the editor's note for the related laws portion (part II) of the city's 1968 Code: "The term `Mayor and Council of Wilmington' has been changed to `city,' and `New Castle County' and `State of Delaware' have been changed to `county' and `state,' respectively. The word `Act' has been changed to `chapter,' `article,' `division' or `section,' as appropriate." Apparently these statements applied only to those provisions not derived exclusively from the Delaware Code. (Back)
