ARTICLE II. - PARKS AND RECREATION ADVISORY COMMISSION [105]


Sec. 38-26. - Established.

Pursuant to section 1-103 of the city charter, the citizens' parks and recreation advisory commission is hereby established.

Sec. 38-27. - Composition, qualifications.

The parks and recreation advisory commission shall be composed of seven residents of the city who shall be qualified by reason of particular interest in, knowledge of or special training or experience in parks and recreational programs, economic development, waterfront recreational activities, landscape architecture, urban planning, construction or administrative management and finance; provided however, that no member shall be an employee of the city or of the county in a position which involves responsibilities with respect to parks and recreational programs.

Sec. 38-28. - Appointment, terms.

The members of the parks and recreation advisory commission shall be appointed by the mayor and serve at the pleasure of the mayor.

Sec. 38-29. - Quorum.

Four members of the parks and recreation advisory commission shall constitute a quorum for the transaction of its business.

Sec. 38-30. - Compensation.

The members of the parks and recreation advisory commission shall serve without compensation.

Sec. 38-31. - Officers.

The parks and recreation advisory commission shall select from among its members a chairman, a vice-chairman and a secretary who shall keep minutes of commission meetings.

Sec. 38-32. - Responsibilities of director.

The director of parks and recreation shall coordinate the staff support to the parks and recreation advisory commission. The director, who is an ex officio member of the Wilmington Park Trust Fund Commission (WPTFC) pursuant to charter section 3-905, shall act as liaison between the WPTFC and this commission in order that the members shall be fully advised of all ongoing functions and any new or additional activities of each commission.

Sec. 38-33. - Limitation of authority.

The role of the parks and recreation advisory commission is solely advisory in nature, and its activities shall in no way touch upon or interfere with the operation of those departments responsible for the day to day maintenance of city parks, public spaces, or recreation programs.

Sec. 38-34. - Responsibilities generally.

(a)

The parks and recreation advisory commission shall undertake the following responsibilities and periodically advise the director regarding each of the same:

(1)

Survey the interest in, needs of, and feasible improvements to parks and recreation programs and activities from the perspective of city residents and others who are served by such programs.

(2)

Assist the department in identifying and seeking support for parks and recreation capital fund improvement projects.

(3)

Identify new ways and means by which the programs and activities of the department can be successfully promoted.

(b)

The commission shall advise and consult with the city and county departments of parks and recreation concerning existing and proposed activities, special events and programs, including the capital programs and capital budgets and the annual operating budgets, in parks owned by the city.

Sec. 38-35. - City, county programs.

The parks and recreation advisory commission shall review and make advisory recommendations to the city and county parks and recreation departments, to the city and county councils and to the county beautification board concerning parks and recreation programs and any capital improvements in any and all parks which are located in the city and in those parks which are owned by the city and are leased to and maintained by the county, currently and specifically, the Canby Park, the Greenhill Municipal Golf Course, the North and South Brandywine Parks, and the Rockford Park.

Sec. 38-36. - Development proposals.

The parks and recreation advisory commission may review physical development proposals with respect to plans for beautification of city streets and avenues, plans for designation of open space areas, physical improvements in parks within the city, and plans regarding development and recreational activities within the designated waterfront areas along the Brandywine and Christina rivers.

Sec. 38-37. - Gift catalog.

The parks and recreation advisory commission shall prepare and distribute copies of and maintain a parks and recreation gift catalog which shall include items of equipment or other property, such as but not limited to outdoor benches, basketball nets and backboards, and similar items which are suitable for use in the city's parks and recreation programs. Private persons, organizations or entities may select items from the catalog to be purchased by them, or on their behalf by the department, at the dollar amount specified therein to be contributed by them to the department of parks and recreation for parks and recreation program purposes in a manner consistent with applicable law. Such catalog shall be prepared at the earliest possible time and thereafter be maintained by the commission and the department.
