The Wilmington Orange Street farmers' market is hereby established. A market master shall be selected by the office of economic development to administer and implement the rules and regulations for the operation of the market.

The Wilmington Orange Street farmers' market shall be located in the surface parking lot between West Eighth Street and Girard Street and between Orange and Tatnall Streets on Wednesdays, Fridays and Saturdays between the hours of 7:00 a.m. and 9:00 p.m., and within the perimeter of Rodney Square as bounded by King Street, Tenth Street, Market Street and Eleventh Street on Wednesdays between the hours of 10:00 a.m. and 3:00 p.m. until another location is selected and is approved by ordinance of the council.

The operation of the Wilmington Orange Street farmers' market shall be limited to the hours of 7:00 a.m. to 9:00 p.m. on Wednesday, Friday and Saturday.

Sec. 42-619. - Rules and regulations generally; clerk.
(a)
The department of licenses and inspections shall adopt and promulgate rules and regulations as to the operation of the market. Such regulations shall cover, but not be limited to, the number of stalls, the manner of vehicular parking, the allocation of stalls, the manner of determination of eligibility of all vendors, applications for stalls, sanitary quality of food and manner in which food is sold.
(b)
The rules and regulations shall be administered by the clerk of the market who shall be a code enforcement officer of the department of licenses and inspections.
(c)
Until such rules and regulations shall be adopted, the existing ordinances governing the administration of the farmers' market shall continue in effect.
(d)
A copy of such rules and regulations shall be delivered to each occupant upon payment of the yearly fee.

The fee for spaces in the Wilmington Orange Street farmers' market shall be $100.00 yearly for those vendors who have vended at the market prior to July 9, 2003, payable on July 1, and $15.00 per market day for any vendor who has not vended at the market prior to July 9, 2003, payable to the market master no later than the market day for which the vendor will occupy a space at the market.

Sec. 42-622. - Use of temporary, removable stands.
Temporary, removable stands for the display and sale of products may be used by occupants of the farmers' market on the premises in conformity with the rules and regulations adopted by the department of licenses and inspections pertaining to the operation of the farmers' market. There shall be no encroachment onto the right-of-way adjoining any part of the premises along Eighth Street, Girard Street, Orange or Tatnall Streets.

Sec. 42-623. - Inspections and examinations generally.
The department of licenses and inspections shall have the right to make inspections and examinations of all foods offered for sale at the farmers' market and of the places where they are prepared.

Sec. 42-624. - Application of health regulations as to the care, sale, etc., of food.
Except as otherwise provided by this article, all of the provisions of the Code and other ordinances, rules and regulations of the city relating to the handling, care, disposal and sale of food and food products which are generally applicable within the city shall be likewise applicable to all food and food products which are sold or offered for sale in the farmers' market of the city.
