ARTICLE XI. - ART MARKET [120]


Sec. 42-641. - Established.

The art market is hereby established to become effective immediately upon approval of this article by the mayor of the city.

Sec. 42-642. - Location.

The art market shall be located in spaces reserved for such use and approved by the public works commissioner in the surface parking lot located between West Eighth Street and Girard Street and between Orange and Tatnall Streets until another location is selected and is approved by ordinance of council.

Sec. 42-643. - Eligibility.

(a)

Spaces in the art market shall be assigned to artists and craftspeople who create tangible works of art and who reside in the state.

(b)

Artists and craftspeople shall be assigned spaces solely for the purposes of displaying, for sale, the artists' or craftspersons' own original work; provided, however, that nothing in this section shall prohibit members of art collectives or associations from displaying, for sale, works of other members of the collective or association. Not acceptable for sale are objects assembled from commercially sold kits and any other commercially made or found objects that are decorated.

(c)

Works may not be displayed or offered for sale if the artist or craftsperson who created them has earlier sold the same works or facsimiles to a local, commercial retailing outlet. As used in this section, commercial retailing outlet does not include art galleries or other outdoor markets that are not associated with commercial retailing establishments or outlets.

Sec. 42-644. - Rules and regulations generally; clerk.

(a)

The Wilmington Arts Commission, in concert with the department of licenses and inspections, shall adopt and promulgate rules and regulations as to the operation of the art market. Such regulations shall cover, but not be limited to, the number of stalls, the manner of vehicular parking, the allocation of stalls, the fees for stalls, the term and renewability of stalls, the application for stalls, the hours and days of operation of the art market, the type and size of removable stands for the display and sale of works, and the manner in which works are sold.

(b)

The rules and regulations shall be administered by the clerk of the farmers' market.

(c)

There shall be no encroachments of stalls or displays onto the right-of-way adjoining any part of the premises along Eighth Street, Girard Street, Orange or Tatnall Streets.
