ARTICLE XII. - KENTMERE PARKWAY [121]


Sec. 42-661. - General.

This article applies to the area on that portion of Kentmere Parkway and Lovering Avenue extending between North Dupont Street and Rockford Road and the intersecting streets along that portion of Kentmere Parkway and Lovering Avenue. For any event or activity that is to be held along that portion of Kentmere Parkway and Lovering Avenue or upon the adjoining and intersecting streets, and that constitutes a "gathering of persons" or "gathering," as defined in title 4 of the Delaware Code and as regulated therein, or constitutes a "parade" as defined in Wilm. C. § 42-442 and as regulated therein, it shall be required that:

(1)

The applicant shall file an application for a permit with the public works department not less than 30 days and not more than 60 days before the date on which it is proposed to conduct the event.

(2)

The application for the permit shall set forth the following information:

a.

The name, address and telephone number of the person seeking to conduct the event. If the event is proposed to be conducted for, on behalf of, or by an organization, the name, address and telephone number of the headquarters of the organization, and of the authorization and responsible heads of such organization is required.

b.

The date when the event is to be conducted.

c.

The route to be traveled, the starting point and the termination point.

d.

The approximate number of persons, animals, if any, and or vehicles which, will constitute such event, including the type of animals, and the description of the vehicles.

e.

The hours when such event will start and terminate.

f.

A statement as to whether the parade will occupy all or only a portion of the width of the streets, sidewalk, park or other public place proposed to be traversed.

g.

Any additional information which the department shall find reasonably necessary to make a fair determination as to whether a permit should be issued.

Sec. 42-662. - Fee.

The applicant shall pay at the time of filing an application for a permit a fee of $50.00.

Sec. 42-663. - Off-duty police officers.

The applicant shall hire an adequate number of off-duty police officers, to be determined by the director of public safety. The failure of any applicant to comply with the provisions of this section shall be punishable upon conviction by a fine in the amount of not less than $500.00.

Sec. 42-664. - Notification.

The applicant shall notify, or cause to be notified, all residents residing along that portion of Kentmere Parkway where the event is to be held, in addition to all residents who reside on Wood Road, Ivy Road, Hill Road, Rockford Road, St. Helena Road, Bancroft Estate Road, Pebble Road, Grant Avenue, Field Road, Foster Place, Kentmere Place Mill Road and Boulder Road. The notification shall be distributed not less than ten days or more than 30 days prior to the event. The notification shall set forth the following information:

(1)

The name, address and telephone number of the person or organization who will be conducting the event.

(2)

The date upon which the event is to occur.

(3)

The route to be traveled, the starting point and the termination point.

(4)

The hours when such event will start and terminate.

The failure of any applicant to comply with the provisions of this section shall be punishable upon conviction by a fine in the amount of not less than $100.00.

Sec. 42-665. - Granting of permit.

The public works department shall not grant any application for an event described herein, if another event has been scheduled on a date that would cause two or more events to be held on the same or consecutive dates. Events may be held on consecutive dates only through a variance adopted by resolution of city council. No permit shall be granted if the event prevents vehicles from accessing the Augustine Bridge.
