ARTICLE III. - AUCTIONS AND AUCTIONEERS


Sec. 5-136. - Revocation of license.

Any license for the conduct of auctions and for auctioneers granted pursuant to this chapter is revocable for violations of applicable laws and regulations.

Sec. 5-137. - Misrepresentations by licensee.

It shall be unlawful for any licensee under this article, or his agents or employees, to make any statements which are false in any particular in the application for the license relating to any article sold or offered for sale; or, which have a tendency to mislead or make any misrepresentations whatsoever with reference thereto.

Sec. 5-138. - Fake, etc., bidding.

No person shall act at any sale at auction regulated by this article as bidder, or what is commonly known as a capper, booster or shiller, or offer or make any false bid, or offer any false bid to buy or pretend to buy any article sold or offered for sale at any such sale at auction.

Sec. 5-139. - Sales exempt from provisions of article.

Nothing in this article shall apply to a judicial sale or sales by executors or administrators or to sales by licensed pawnbrokers of unredeemed purchases in the manner provided by law, nor to sales at public auction by a duly licensed auctioneer at the place of business for the conduct of auction sales of any person coming under this article; provided, that such sale at public auction of the stock on hand of such person shall be held on successive days, Sundays and legal holidays excepted, and shall not continue for more than 30 days in all within the period of any one calendar year.
