Sec. 5-500. - Functions of department generally.
The department of parks and recreation shall have the power and its duty shall be to perform the following functions:
(a)
Formulation of coordinated recreational program. It shall from time to time formulate a comprehensive and coordinated program of cultural and physical recreational activities to be instituted and conducted in all city recreational facilities.
[(b)
Conduct of recreational program. Except as] otherwise provided in this chapter, the department shall institute and conduct all recreational activities in accordance with its recreational program.
(c)
Operation, etc., [of] recreational facilities. Except as otherwise provided in this chapter, the department shall manage and operate all city recreational facilities, and shall construct, maintain, improve and repair such facilities, parks and squares. Jointly with the department of planning and development, it shall determine the location of new recreational facilities.
(d)
Preservation, etc., of historical shrines. The department shall preserve, manage and operate city historical shrines not under the management and operation of any board or commission and make plans for the acquisition by the city of buildings and grounds of historical significance to the city.
Sec. 5-501. - Wilmington Park Trust Fund Commission.
The Wilmington Park Trust Fund Commission may receive and hold in trust for park and recreational purposes, exempt from taxation, any grant or devise of real estate or rights therein, and any gift or bequest of money or other personal property, made for park or recreational purposes by any person or corporation. Such trust property shall be known as Wilmington Park Trust Fund, and the income shall be used and expended under the direction of the department of parks and recreation. The commission may, if it deems it advisable, employ a trust company upon such terms as seem proper. In administering the trust property, the commission may, except to the extent otherwise provided in the instrument making such devise, gift or bequest, be governed by the provisions of 12 Del. C. §§ 3302 and 3304, relating to investment standards and powers of fiduciaries, and to retention by fiduciaries of decedent's or settlor's investment. The commission shall have power to own, hold, sell, transfer and otherwise deal in real or personal property and shall make and file an annual report with the department of parks and recreation, at the close of each fiscal year, giving a full review of the work of the commission during that year. All property heretofore held in trust shall continue in trust for the purposes made by the reconstituted commission as successor trustee.
