CHAPTER 2. - HUMAN RESOURCES DEPARTMENT


Sec. 7-200. - Human resources department functions.

The department shall administer the human resources code.

Sec. 7-201. - Human resources code.

The human resources director shall from time to time recommend changes to the human resources code to the council. The human resources code shall be submitted to the administrative board prior to the submission to the council, and the council shall by ordinance adopt it with or without amendment. The human resources code shall provide for:

(1)

The classification of all city positions, based on the duties, authority and responsibility of each position, with adequate provision for reclassification of any position whenever warranted by changed circumstances;

(2)

A pay plan for all city positions;

(3)

Methods for determining the eligibility, merit, and fitness of candidates for appointment or promotions;

(4)

Methods for announcing and publicizing vacancies in the city offices, and for filling such positions from eligible candidates whose merit and fitness have been established;

(5)

The hours of work, attendance, holidays, regulations and provisions for sick and vacation leave, and other absences;

(6)

The policies and procedures governing persons holding provisional appointments;

(7)

Policies and procedures regulating transfer of employees and reduction in force;

(8)

The policies and procedures regulating discipline of employees, including removal for cause;

(9)

The granting of credits on entrance examinations to persons who have served in the armed forces of the United States in times of war;

(10)

Grievance procedures, including procedures for the hearing of a grievance by a personnel appeal board, composed of the mayor, the director of human resources, and a department head other than the head of the department out of which the grievance arises;

(11)

The right of the city to contract for special services;

(12)

Such other practices, polices and procedures necessary to the operation of a modern system of personnel administration based on merit principles.

Sec. 7-202. - Duties of city officers and employees.

All officers and employees of the city shall comply with and aid in all proper ways in carrying out the human resources code. All officers shall report currently to the human resources director all disciplinary actions taken by them. All officers and employees shall furnish any records or information which the human resources director may request. Upon request of the human resources director, the city solicitor shall institute and maintain any action or proceeding at law or in equity that the human resources director considers necessary or appropriate to secure compliance with the merit system provisions of this Charter and the human resources code.

No officer or employee of the auditing department shall make or approve or take any part in making or approving any payment for personal services to any person holding a position in the classified service if the human resources director has given notice to the city auditor that such person was not appointed and employed in accordance with the human resources code and merit system.

Sec. 7-203. - Dismissal, demotion and suspension.

Any dismissal or demotion after the completion of the required probationary period of service, or suspension of any employee in the classified service shall be for just cause only.

Sec. 7-204. - Discrimination prohibited.

No person shall be appointed or promoted to, or demoted or dismissed from, any position in the classified service, or in any way favored or discriminated against with respect to any position in the classified service because of race, color, sex, religious beliefs, national origin or political affiliations.
