DIVISION 3. - POSITION ALLOCATION LIST


Sec. 40-36. - Annual position allocation list.

In preparing the budget for each fiscal year, upon recommendation of the director of personnel and approval of the administrative board, city council shall designate by ordinance a list of positions that shall be funded through the city's annual budget, which position allocation list shall include all elected, appointed, and classified service positions. Incumbents of such allocated positions shall be eligible for city-provided benefits as set forth in this chapter.

Sec. 40-37. - Position allocation list amendments.

(a)

By ordinance of city council pursuant to City Charter chapter 3, section 2-300(6), at any time, and as specifically provided in this chapter, the position allocation list for any fiscal year may be amended to change the title, pay grade, and/or salary range of any position.

(b)

By ordinance of city council pursuant to City Charter chapter 3, section 2-300(6), at any time, and as specifically provided in this chapter, positions in the appointed, classified, and executive and managerial services may be added to or removed from the position allocation list.

Sec. 40-38. - Allocation of classified service positions—Removal or reclassification of vacant positions.

The personnel director shall notify the administrative board of any classified service position that has been vacant for six consecutive months; at its discretion, the administrative board may meet for the purpose of reviewing whether that position should be removed from the position allocation list or reclassified. The administrative board shall advise the city council, the personnel director and the finance director of any recommendations it may make as to removing a position from the position allocation list or reclassifying a position. If the city council thereafter by ordinance approves such action, the position allocation list for that fiscal year shall be revised accordingly.

Sec. 40-39. - Allocation of police department and fire department limited term uniformed recruit positions; training and employee benefits.

In each fiscal year, the position allocation list may include a specific number of positions in the police and fire departments designated "limited term uniformed employee," at a pay grade as stated in such list. Such positions may be authorized in numbers sufficient to enable each department, regardless of attrition, to complete during the fiscal year the training of the maximum number of new regular personnel then permitted by the position allocation list. In the event sufficient attrition does not occur by the completion of training, or a reasonable time thereafter, limited term uniformed employees shall not be entitled to continued employment with the city or to any employee benefits or rights such as, but not limited to, layoff or recall/reemployment.
