Subdivision VII. - Transfers

Sec. 40-166. - Classified service—Transfers generally.

With the approval of the director of personnel, the commissioner or department head may transfer an employee from one position to another position in the same pay grade and step or at the same salary level. If such transfer involves a change in department assignment, both commissioners or department heads must consent thereto before the action shall be considered effective. If the city council shall order the transfer, however, such consent shall not be required.

Sec. 40-167. - Same—Transfer; notice to and wishes of employees.

Whenever possible, an employee being considered for transfer shall be provided with a reasonable period of notice in advance of the proposed effective date of such transfer. The employee's wishes with respect to the proposed action shall be taken into account to the extent practicable, provided that the commissioner(s) or department head(s) shall give priority to the efficient operation of the department(s) concerned in making any decision regarding transfer.

Sec. 40-168. - Same—Temporary transfer; compensation.

(a)

At the discretion of the department head(s) or commissioner(s) involved, employees may be temporarily transferred to any other position in the city service. Temporary transfer shall not exceed 30 working days, unless the parties mutually agree that such period may be extended. Salary anniversary dates shall not change due to temporary transfers.

(b)

Any employee temporarily transferred to a position in a higher pay grade or salary level shall be paid at the lowest step in the higher grade that exceeds his or her present rate of pay by a minimum of $500.00 per year, but only for the period of the temporary transfer. Any employee temporarily transferred to another position in the same pay grade or salary level shall be paid at the same step as was applicable prior to the transfer. Any employee who is temporarily transferred to a position in a lower pay grade or salary level shall be paid at the rate and the step of the position from which s/he was temporarily transferred.
