Sec. 40-151. - Classified service—Probationary period, extension of probationary period.
(a)
Except as specifically provided in this chapter, all classified service employees shall be considered probationary employees for at least the first 90 calendar days of employment, after which s/he will be considered a regular employee, provided that the employee has evidenced the ability to satisfactorily perform the duties of the position. Upon the recommendation of the department head or commissioner and the approval of the director of personnel, the probationary period for any employee may be extended for a period not to exceed an additional 90 calendar days. The commissioner or department head shall notify the employee of such extension of the basic probationary period.
(b)
Periods of time on approved leave(s), for any reason, shall not be counted toward completion of a probationary period. Time worked as a limited service employee or as a provisional appointee may not satisfy the employee's probationary requirement.
(c)
Except as provided in this article, during an employee's probationary period, the employee has no entitlement to continued employment, may be discharged, and shall not have grievance rights.

Any regular employee who does not satisfactorily complete the probationary period in a position to which s/he has been promoted shall have the right to return to the position from which s/he was promoted, unless the employee is discharged for just cause, including inability to perform the functions of the job, due to circumstances that would have called for the employee's discharge from the regular position as well. Sec. 40-153. - Same—Completion of probationary period.
An employee shall be considered a regular member of the classified service upon completion of the specified probationary period, provided that the commissioner or department head certifies to the director of personnel that the services of the employee have been satisfactory and that the employee is recommended for such employment.
