(a)
Applicability. Rate Schedule A shall apply in the following situations:
(I)
Inside city rate:
(1)
Connections which were subject to Schedule A rates prior to the adoption of this resolution (June 12, 1978);
(2)
Connections which are made as part of a water assessment project inside the municipal limits of the City of Winston-Salem, Village of Clemmons or Town of Rural Hall and are not subject to any subsequent rate structure;
(3)
Connections which are made entirely at a developer's expense in accordance with Water Line Extension for Subdivisions (Section 64(c)(2) of this resolution) inside the municipal limits of the City of Winston-Salem, Village of Clemmons or Town of Rural Hall and are not subject to any subsequent rate structure;
(4)
All water customers residing within the municipal limits of the City of Winston-Salem, Village of Clemmons, Town of Rural Hall, or annexed into one (1) of these, and that are not subject to any subsequent section's rate structure; will pay inside-corporate-limits water rates through each meter as set forth below:
(5)
Base charges. The minimum base charge to any customer of water within the corporate limits of the city through any one (1) meter shall be as follows:
(i)
Charted rates based on a thirty-day cycle for monthly billing and a sixty-day cycle for bimonthly billing. Base charges are subject to proration based on actual length of billing cycle.
(II)
Outside city rate:
(1)
All water customers residing outside the municipal limits of the City of Winston-Salem, Village of Clemmons, Town of Rural Hall, and that are not subject to any subsequent rate structure;
(2)
Any feasibility customer that has completed its debt service period of twenty-two (22) years and who resides outside the municipal limits of the City of Winston-Salem, Village of Clemmons, Town of Rural Hall, and are not subject to any subsequent rate structure will pay the outside city water rates as set forth below:
(3)
Base Charges. Under this section, the minimum base charge to any customer of water through any one (1) meter shall be as follows:
(i)
Charted rates based on a thirty-day cycle for monthly billing and a sixty-day cycle for bimonthly billing. Base charges are subject to proration based on actual length of billing cycle.
(b)
Monthly rate of private hydrants and sprinkler connections for unmetered industrial, etc., users. All owners of private water hydrants and sprinklers connected within the corporate limits of the city directly to the city water system, without any meter, and serving industrial, commercial or institutional facilities, shall be charged monthly, as follows:

For sprinkler connections in excess of the above schedule, an annual charge of three dollars ($3.00) per inch will be made in addition to the basic charge of twenty-six dollars and fifty eight cents ($26.58) per inch for twelve-inch connections.
The annual rate of unmetered private hydrants and sprinklers outside the city shall be one and one-half (1½) times the rates charged inside the corporate limits.
(c)
Certain residential properties exempt from annual fire hydrant charge. Private fire hydrants serving residential properties, such as apartment projects, condominium complexes and townhouse complexes, or private residences abutting on a private street on which there are situated fire hydrants, will not be subject to an annual fire hydrant charge since the cost of providing adequate fire defenses for residential property is included in the user charges paid by the occupants of such residential property.
(d)
Use of private fire hydrant without city's permission prohibited. It shall be unlawful for any person to use a private fire hydrant connected with the city's water system without any meter, regardless of whether it is situated in an industrial, commercial, institutional or residential zone, unless and until permission has been granted by the city in accordance with Section 17 of this resolution.
(e)
Rate for filling privately owned swimming pools. In each instance where the city is called upon to fill a privately owned swimming pool (that is, any swimming pool not owned by the City of Winston-Salem) from a fire hydrant or other connection requiring the services of one (1) or more city employees, a special charge of thirty dollars ($30.00) per hour per employee, minimum charge sixty dollars ($60.00), shall be made for such service. The charge shall be computed from the time the city employee or employees leave his or their base of operations until such employee or employees return thereto. This charge shall be an addition to the regular charge for the water used at the then current water rates.
(f)
Sale of water at treatment plants. The city shall also make water available for sale to the public at the three (3) water treatment plants and there will be a special charge of twenty dollars ($20.00). This charge will be in addition to the regular charge for the water used at the then-current water rates.

Sec. 31. - Water rates—Schedule B (feasibility, annexed feasibility, outside county feasibility).
(a)
Applicability. Rate Schedule B shall apply in the following situations:
(I)
Feasibility rate, minimum consumptions and base charges:
(1)
Connections which were subject to Schedule B rates prior to the adoption of this resolution (June 12, 1978);
(2)
Connections which are made in accordance with Water Line Extension for Subdivisions (Section 64(c)(2) of this resolution) outside the municipal limits of the City of Winston-Salem, Village of Clemmons, or the Town of Rural Hall;
(3)
Connections which are made to any water mains extended under the Winston-Salem/Forsyth County Utility Commission Feasibility Extension Plan (Section 64(b) of this resolution) will pay feasibility rates as set forth below:
(i)
Reduction in water rates. Effective in 1997, all connections which, as of October 1 of each year, have been installed for twenty-two (22) years under this rate shall have their water rates reduced to the Schedule A outside city rate of Section 30(a)(II). Said reduction to occur on October 1 of each year.
(4)
The minimum consumption charge and base charge for any customer of water under the feasibility rate through any one (1) meter shall be as follows:

(i)
Reduction in water rates. Effective in 1997, all connections which, as of October 1 of each year, have been installed for twenty-two (22) years under this rate shall have their water rates reduced to the Schedule A inside city rate of Section 30(a)(I). Said reduction to occur on October 1 of each year.
(2)
The minimum consumption charge and base charge for any customer of water under the annexed feasibility rate through any one (1) meter shall be as follows:

Any customer whose property is located outside the Forsyth County limits and receives water service from a Winston-Salem/Forsyth County Utility Commission maintained water main will pay the outside county rate as set forth below:
(2)
Base charges. Under this section, the minimum base charge to any customer of water receiving service from a Winston-Salem Forsyth County Utility Commission maintained water main through any one (1) meter shall be as follows:
(i)
Charted rates based on a thirty-day cycle for monthly billing and a sixty-day cycle for bimonthly billing. Base charges are subject to proration based on actual length of billing cycle.
(b)
Monthly rate for private hydrants and unmetered sprinkler connections. The monthly rate for private hydrants and unmetered sprinkler connections shall be as follows:

All consumers of water within the corporate limits of Kernersville shall be charged for water delivered through each meter each month/bi-month as follows:

Base Charges. Under this section, the minimum base charge to any customer of water receiving service from a Winston-Salem Forsyth County Utility Commission maintained water main through any one (1) meter shall be as follows:
(i)
Charted rates based on a thirty-day cycle for monthly billing and a sixty-day cycle for bimonthly billing. Base charges are subject to proration based on actual length of billing cycle.
(II)
Outside Kernersville:
(1)
All consumers of water outside the corporate limits of Kernersville shall be charged for water delivered through each meter each month/bi-month as follows:

(a)
Applicability. All water customers residing in the Town of Walkertown, or annexed into the town, will pay water rates as set forth below:

(i)
Charted rates based on a thirty-day cycle for monthly billing and a sixty-day cycle for bimonthly billing. Base charges are subject to proration based on actual length of billing cycle.
(b)
Monthly rate for private hydrants and unmetered sprinkler connections. The monthly rate for private hydrants and unmetered sprinkler connections shall be as follows:

(d)
Rates for filling privately owned swimming pools. Section 30(e) of this resolution shall apply to Walkertown connections. The appropriate current Walkertown rates shall be used to compute the charge for the water used to fill such swimming pools.

Sec. 35. - Collection of water charges; penalties for failure to pay.
(a)
All charges for water supplied by the city shall be made monthly or bimonthly and shall be due on the day following the date the bill is mailed.
(1)
Service initiation fee. A non-refundable service fee of twenty dollars ($20.00) will be charged to all customers requesting water and sewer service. At the option of the customer, the fee shall be collected upon activating the service or billed on the customer's first bill. This fee will cover the costs associated with account setup and service activation in the field, and will apply to all accounts at the time of activation, including seasonal accounts that are activated on a yearly basis such as irrigation meters.
(2)
Service deposits. Upon the initial service request, all customers excluding governmental units and industrial companies may be subject to a credit evaluation to determine if a deposit will be required for service activation. Based on the results of the credit evaluation, a security deposit up to one hundred fifty dollars ($150.00) may be collected. Any customer whose delinquent balance due shall remain unpaid after the service termination date, may be required to make a penalty deposit. The penalty deposit will be equal to one and one-half (1½) times the average usage billed over the prior six (6) months. If not paid immediately, a deposit will appear as a new charge during the next billing cycle and the customer's service will be subject to termination for failure to pay. In all cases, the deposit amount may be rounded up to the nearest ten dollars ($10.00). Any deposits made pursuant to this section may be applied to any future charges that become delinquent. The deposit shall be refunded in its entirety if two (2) years pass without any penalties occurring. This refund shall be applied in the form of a credit against the customer's water/sewer account. Otherwise, the deposit shall remain on the account indefinitely, or until the customer requests final termination of service and a final bill is rendered. At this time, the said deposit shall be applied to any final billed amount and any overage shall be refunded to the customer provided the customer owes no delinquent water/sewer bills for any other account.
(b)
Customers shall adhere to the following billing schedule for connections subject to Schedule A, B, C, Kernersville and Walkertown rates:
(1)
If any charge shall remain unpaid on the twenty-eighth day after the bill date of such charges, a ten (10) percent penalty will be applied to such unpaid balance. Penalties on unpaid charges under this section will not be more than five hundred dollars ($500.00). The penalty may not be applied if unpaid charges are less than ten dollars ($10.00).
(2)
If a bill is unpaid thirty-five (35) days after the bill was mailed a notice of termination shall be mailed to the customer. If the thirty-fifth day falls on a weekend or a holiday, the notice shall be mailed on the next business day. This notice shall inform the customer of the earliest possible date of service termination, and shall contain information as required in Section 16(a).
(3)
If a bill is unpaid forty-nine (49) days after the bill was mailed, service shall be cut off by locking or removing the meter. If the forty-ninth day occurs on a weekend or a holiday, said action will be taken on the next business day. The outstanding balance, plus penalties, shall be paid before service is restored. A final penalty of twenty dollars ($20.00) will be added to the unpaid balance forty-nine (49) days after the original bill date, if payment has not been received by that date.
(c)
All water/sewer bills shall be payable at any city revenue office.
