ARTICLE II. - PEDDLERS AND SOLICITORS


Sec. 15-20. - Application of general provisions.

Unless the provisions of this article otherwise provide, all of the provisions of Article I of Chapter 15 are applicable to the licenses referred to in this article.

Sec. 15-21. - Definitions.

(a)

Peddler. The word "peddler" includes the terms "solicitor" and "hawker" and "other itinerant vendor" and refers to a person who travels about selling any merchandise, retail or wholesale, including but not limited to liquids or edibles for human consumption, for contemporaneous delivery.

(b)

Established place of business. The phrase "established place of business" refers to business at a geographically fixed location.

(c)

Vehicle. The word "vehicle" includes, but is not limited to, any vehicle moved by human, animal, mechanical or motor power.

(d)

Location. A peddler who comes under this article may conduct business in any one location during a 24-hour period for no more than two hours on private property upon obtaining permission of the property owner or no more than 15 minutes in a public right-of-way. At the expiration of the time period described herein, the peddler must relocate his vehicle at least 1,000 feet from the prior location.

Sec. 15-22. - Farmers; exemption.

Any farmer who is engaged in the business of preparing, producing, displaying or selling food or produce grown on the site shall not be required to comply with the provisions contained in this article.

Sec. 15-23. - No fee required.

The following individuals shall be exempt from any fees required under chapter:

(1)

Veterans. Upon the applicant providing appropriate proof to the license issuer, a license under this article shall be issued without payment of any fees to any honorably discharged veteran from any branch of the United States Armed Forces.

(2)

Interstate peddlers. Interstate peddlers, upon adequate proof that his or her sole business is to solicit orders for merchandise to be shipped from another state at some later time, shall be issued a license under this article without payment of any fees.

Sec. 15-24. - Form of application and license.

In addition to any other information required by the county license issuer, the application and license shall contain the following information:

(1)

Description of vehicle. A description of all vehicles that will be used for the conveyance of the merchandise. The description shall include the license and registration numbers of any motor vehicle, advertising or business markings on the exterior of each vehicle, and the capacity and nature of storage facilities within each vehicle;

(2)

Geographical area. A description of the geographic area where the business will take place;

(3)

Licensee. The name, description, and current address of the licensee;

(4)

Use by applicant only. A statement that the license applies only to the person whose name appears on the face of the license.

Sec. 15-25. - Investigation of applicant.

For the purpose of investigating applications filed under this article, the sheriff and the health department shall serve as the investigating agencies. The agencies shall investigate applications in compliance with the provisions of section 15-8 of this chapter.

Sec. 15-26. - Hours of business.

It shall be unlawful for any peddler to peddle, hawk, or vend any merchandise away from an established place of business between the hours of 8:00 p.m. of any day and 8:00 am. of the following day.
