ARTICLE IV. - DANCES, DANCE HALLS


Sec. 15-49. - Application of general provisions.

Unless the provisions of this article otherwise provide, all of the provisions of Article I of Chapter 15 are applicable to the licenses referred to in this article.

Sec. 15-50. - Definitions.

(a)

Public dance. Any dance to which the general public is admitted upon the payment of any fee or charge of admission whatever, or for which tickets, invitations or other admission devices are sold, or offered for sale, or which is given or conducted in connection with the sale of food or alcohol in restaurants, taverns, cafes, or hotel dining rooms to which the general public is admitted, or given or conducted in connection with the provisions of other amusement or entertainment for profit.

Public dance hall. Any hall, room, or place in which a public dance is held.

Sec. 15-51. - Exemptions.

The following public dances are exempt from the provisions of this chapter:

(1)

Charitable dances. Any dance held or conducted for the purpose of raising funds for an established or recognized charitable organization, or by any church, Sunday school, established or recognized youth organization, or bona fide fraternal organization, labor organization, parent teachers' association, veteran's organization, civic or community organization or group, the primary purpose of which is the betterment of the cultural, social, economic, welfare and environment of the community.

School dances. Any school dance.

Sec. 15-52. - Investigation of applicant.

For the purposes of this article, the sheriff; the health officer and the fire control officer shall serve as the investigating agencies. The investigations shall be conducted in compliance with the provisions of section 15-8 of this chapter.

Sec. 15-53. - Police or private patrol attendance.

Every person desiring to conduct a public dance shall employ private security guards. The sheriff shall determine the number of guards required to be present when the dance is being conducted. The guards shall be present during all times such dances are being conducted. The sheriff shall determine whether it is necessary to assign deputies to be in attendance for the purpose of assisting in the enforcement of this article. The expense of such deputies shall be paid for by the person conducting the dance, but the deputies' presence shall not relieve the person giving the dance of any liability for any violation of the provisions of this article.
