ARTICLE IX. - UNDERGROUND STORAGE OF HAZARDOUS SUBSTANCES


Sec. 15-185. - Application of general provisions.

Unless the provisions of this article otherwise provide, all of the provisions of Article I of Chapter 15 are applicable to the licenses referred to in this article.

Sec. 15-186. - Definitions.

(a)

Except as otherwise provided, California Health and Safety Code Section 25281 is hereby referred to, and adopted with the same effect as if fully set forth herein.

(b)

The "local agency" responsible for implementing the provisions of Health and Safety Code Sections 25280 et seq. shall be the county public health department.

Sec. 15-187. - Filing of application for permit.

All applications for a permit to operate an underground storage tank shall be filed with the local agency as defined in section 15-186 of this article.

Sec. 15-188. - Contents of application.

The application for a permit to operate an underground storage tank shall conform to the requirements as set forth in Health and Safety Code Section 25286 and contain any other information as is deemed necessary by the license issuer to administer the provisions of this article.

Sec. 15-189. - Term.

The term of the permit to operate shall be five years.

Sec. 15-190. - Annual report.

As a condition of any permit to operate an underground storage tank, the permittee shall complete an annual report form prepared by the local agency, which shall detail any changes in the usage of any underground storage tanks, including the storage of new hazardous substances, changes in monitoring procedure and unauthorized release occurrences.

Sec. 15-191. - Design standards and monitoring systems for new and existing facilities.

Underground storage tanks installed after January 1, 1984 shall meet the standards set forth in Health and Safety Code Section 25291. Underground storage tanks installed before January 1, 1984 shall meet the standards set forth in Health and Safety Code Section 25292.

Sec. 15-192. - Violations.

In addition to the penalties described in Health and Safety Code Section 25299 for the violations stated therein, any permit issued pursuant to this article is subject to suspension or revocation.

Sec. 15-193. - Unauthorized release; recording and reporting requirements.

In the event of an unauthorized release, the permittee shall comply with the requirements of Health and Safety Code Sections 25294 and 25295.

Sec. 15-194. - Abandonment.

The permittee may not abandon, close or temporarily cease operation of an underground storage tank except upon compliance with Health and Safety Code Section 25298.
