ARTICLE V. - SALE AND TRANSPORTATION OF HAY OR STRAW


Sec. 23-90. - Pickup order.

Any person who transports baled hay or straw upon any highway, street, road, avenue or other public thoroughfare in the unincorporated area of Kings County shall obtain a pickup order from the person from whom the baled hay or straw was obtained. The pickup order shall state the following:

(1)

Name, address and telephone number of the person from whom obtained;

(2)

Date and location from which the hay or straw is to be removed;

(3)

Name and address of the person obtaining the hay;

(4)

A description of the hay or straw to be transported as to the kind, number and description of the bales;

(5)

Name and address of the purchaser or transferee;

(6)

Name and address of the driver doing the transporting;

(7)

Destination;

(8)

A description including the license number of the vehicle used in the transportation.

Sec. 23-91. - Transportation without order unlawful.

It is unlawful for any person or the agent of any person to transport or offer to transport upon any highway, street, road, avenue or other public thoroughfare within the unincorporated area of Kings County in or upon any vehicle, any baled hay or straw unless the person operating such vehicle has in his possession a duly executed pickup order as described in this article.

Sec. 23-92. - Display of pickup order.

Any person loading or transporting baled hay or straw shall display his copy of the pickup order to any peace officer on request. Any peace officer is authorized to conduct inspections of pickup orders either in route or at points of departure or destination.

Sec. 23-93. - Retention and display of pickup orders.

The purchaser or transferee of baled hay or straw shall retain the pickup order in his possession for a period of six months and display the same to any peace officer on request.

Sec. 23-94. - Exceptions.

The provisions of this article shall not apply to the producer of baled hay or straw transporting the same for his own use.

Sec. 23-95. - Weighmaster certificate in lieu of pickup order.

In lieu of a duly executed pickup order, possession and display of a licensed weighmaster's certificate by a person transporting hay shall meet the requirements of this article.

Sec. 23-96. - Corrections.

In the event that a person is not in possession of a valid, duly-executed pickup order at the time he is stopped and questioned by a law enforcement officer while loading or transporting baled hay or straw, any citation issued shall be held for a period of 72 hours to allow the person to produce acceptable proof of execution of a pickup order. If the proof is provided, the citation shall be voided. If the proof is not produced within that time period, the citation shall be processed.

Sec. 23-97. - Violations.

Every person violating the provisions of section 23-90, section 23-91, section 23-92, and section 23-93 shall be guilty of a misdemeanor punishable under the provisions of section 1-8 of this Code.
