ARTICLE XXX. - NEWPORT NEWS CABLE TELEVISION ADVISORY COMMISSION


Sec. 2-664. - Created; composition.

The Newport News Cable Television Advisory Commission is hereby created as an official advisory commission to the Newport News City Council. The commission shall consist of ten (10) members. The city manager, the city attorney and the superintendent of schools, or their respective authorized representatives, shall serve as nonvoting ex officio members. The remaining seven (7) members shall be voting members appointed by city council and shall be residents of the City of Newport News so long as they shall serve on the commission.

Sec. 2-665. - Terms of members; vacancies.

(a)

The terms of the nonvoting ex officio members shall correspond to their respective official tenures. The terms of appointed voting members shall be three (3) years each. The members so appointed shall hold office during their respective terms and until their successors are appointed. All appointed member vacancies on the board shall be filled by the city council for the unexpired portion of the term. Any member of the board may be removed by the city council at any time if it finds the best interests of the city would be served by such action.

Effective January 1, 2006, appointments to fill vacancies in those membership positions on the board whose terms expired on August 31, 2005, shall be as follows: one (1) appointment shall expire on December 31, 2006, one (1) appointment shall expire on December 31, 2007, and one appointment shall expire on December 31, 2009; after which dates, future appointees to these three (3) positions shall serve three-year terms as provided in subparagraph (a), which terms shall expire on December 31 three (3) years subsequent to the expiration of the previous term.

Sec. 2-666. - Organization; quorum.

The commission shall elect the officers thereof, which shall consist of a chairman and a vice-chairman, to be elected annually on the anniversary of the commission's initial organizational meeting, said officers to serve terms of one (1) year each, but not to exceed two (2) consecutive terms. A majority of the voting members of the commission shall constitute a quorum for the transaction of business.

The initial organizational meeting of the commission shall be called and chaired by the city manager, or his representative, within sixty (60) days after completion of the appointments of the five (5) voting members, by giving reasonable notice thereof to all members of the commission of the time and place of the meeting. The first order of business of the commission at its inaugural meeting shall be the election of a chairman and a vice-chairman, the city manager, or his representative, chairing the meeting until the chairman is elected.

Sec. 2-667. - Responsibilities and duties.

The commission shall make a study of cable television in the city with regard to future extensions and improvements of the system and in connection therewith shall make such recommendations as it shall deem advisable to the city council. The commission shall monitor all aspects of the implementation and operation of the cable television franchise. It shall have authority to conduct hearings open to the public to inquire into the merits of any complaints, criticism or recommendations made to it by subscribers, users or patrons of the service, or by any other citizen of Newport News, whether or not they subscribe to the service.

The commission shall have exclusive original jurisdiction of all complaints made to the city concerning the cable television franchise. Any party dissatisfied with the commission's disposition of its complaint may thereafter present the matter to city council.

The commission shall have authority to promulgate and enforce its own rules in connection with its investigations and hearings on complaints. Such rules shall be consistent with the provisions of this article and the cable television franchise ordinance.
