ARTICLE I. - IN GENERAL


Sec. 36-1. - Definitions.

For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section, unless a different meaning clearly appears from the context:

Charitable shall mean and include the words patriotic, philanthropic, social service, welfare, benevolent, educational, civic or fraternal, either actual or purported.

Contributions shall mean and includes the words alms, food, clothing, money, subscription, property or donations under the guise of a loan of money or property.

House shall mean any private dwelling, whether single or multifamily.

Person shall mean any individual, firm, copartnership, corporation, company, association or joint stock association, church, religious denomination, society, organization or league, and includes any trustee, receiver, assignee, agent or other similar representative thereof.

Promoter shall mean any person who promotes, manages, supervises, organizes or attempts to promote, manage, supervise or organize a campaign of solicitation.

Religious and religion shall mean and include the word "charitable," as herein defined, but shall be given their commonly accepted definitions.

Solicit and solicitation shall mean the request, directly or indirectly, of money, credit, property, financial assistance or other thing of value. A solicitation shall be deemed completed when made, whether or not the person making the same receives any contribution or makes any sale referred to in this section.

Sec. 36-2. - Violations of chapter.

Unless otherwise specifically provided, a violation of any provision of this chapter shall constitute a Class 4 misdemeanor.

Sec. 36-3. - Permission for solicitations by religious or charitable organizations.

(a)

No religious or charitable organization which is qualified as such by the federal internal revenue service shall engage in any solicitation within the city without permission from the chief of police. Such permission shall be requested in writing and, if granted, shall be for a period of no longer than one (1) year. Religious and charitable organizations which have been granted "exempt" status by the state administrator of consumer affairs shall not be required to obtain permission from the chief of police, but such "exempt" organizations shall have a copy of their current exemption on file with the chief of police prior to any solicitation within the city.

The chief of police may revoke such permission in the same manner and for the same reasons as provided for the revocation of permits under Article II of this chapter.

Sec. 36-4. - Misrepresentations, deception, etc., in soliciting contributions.

No person shall, directly or indirectly, solicit contributions for any purpose by misrepresentation of such person's name, occupation, financial condition, social condition or residence, and no person shall make or perpetrate any other misstatement, deception or fraud in connection with any solicitation of any contribution for any purpose in the city.
