6.04.005 Use of definitions.

When interpreting Title 6 of the code, words defined in this chapter shall have the meanings given unless the context indicates otherwise. (Ord. 93-0019 § 2 (part), 1993.)

6.04.010 Active service.

“Active service” means time spent on active on-the-job performance of the duties of a position, and on any authorized paid leaves of absence. (Ord. 93-0019 § 2 (part), 1993.)

6.04.020 Anniversary date.

“Anniversary date” means and refers to a date which is one calendar year after the date of entry into a position compensated on the basis of steps. Such definite date is established in various sections elsewhere in this title. (Ord. 93-0019 § 2 (part), 1993.)

6.04.030 Board.

“Board” means the board of supervisors of the county of Los Angeles. (Ord. 93-0019 § 2 (part), 1993.)

6.04.035 Code.

“Code” means the Los Angeles County Code of which this Title 6 is a part. (Ord. 93-0019 § 2 (part), 1993.)

6.04.040 Continuous service.

A. “Continuous service” means:
1. For positions compensated on a monthly or annual basis: service during the regular hours or shifts of the position in which the person is employed;
2. For positions compensated on a daily or hourly basis: services of at least an average of 20 days or 160 hours during each of six consecutive calendar months;
3. For certain positions in the probation department assigned to forestry and probation camps: 52 or more on-duty periods of 56 hours each during 12 consecutive months.
B. The following shall not be considered an interruption of continuous service:
1. Paid sick leave;
2. Paid vacation;
3. Approved leaves of absence;
4. Absences not exceeding:
a. Three consecutive working days,
b. Two on-duty shifts;
5. Reentering county service within three working days after termination;
6. Reemployment pursuant to the Charter and/or statutes following a resignation to serve in the armed forces. (Ord. 93-0019 § 2 (part), 1993.)

6.04.045 Department head.

For purposes of Section 6.10.075 of the County Code, “department head” means a person formally designated as an acting department head, the employee who has the highest classification in a department which has no regularly appointed department head or designated acting department head, and the director of the Museum of Natural History, as well as regularly appointed department heads. 6.04.046 Latest hire date.

“Latest hire date” means the date of hire for a new employee, or the most recent date of hire for a rehired employee. (Ord. 93-0019 § 2 (part), 1993.)

6.04.050 Member.

“Member,” when referring to a member of an assessment appeals board, includes an alternate member of such an assessment appeals board. (Ord. 93-0019 § 2 (part), 1993.)

6.04.055 Nonrepresented employee.

“Nonrepresented employee” means an employee who is not represented by an employee organization certified by the employee relations commission. (Ord. 93-0019 § 2 (part), 1993.)

6.04.060 Paragraph.

“Paragraph” means a paragraph of a section of the ordinance codified in this title unless a paragraph of a section of another ordinance or statute is mentioned. (Ord. 93-0019 § 2 (part), 1993.)

6.04.065 Pay period.

“Pay period” means one of the two periods into which each month is divided for payroll purposes: the first day of the month through the fifteenth day of the month, and the sixteenth day of the month through the last day of the month. (Ord. 93-0019 § 2 (part), 1993.)

6.04.070 POST position.

“POST position” means any position assignment as to which the department head has determined that its duties must be regularly performed on a predetermined schedule at a specified location, irrespective of holidays, the regular workweek, or normal business hours. (Ord. 93-0019 § 2 (part), 1993.)

6.04.080 Public entity.

“Public entity” means:
A. The county of Los Angeles;
B. Any district or other political subdivision of which the board is ex officio the governing body;
C. The office of marshal of the municipal courts of the county of Los Angeles;
D. The Superior Court or a municipal court of this county, except that a judge of such court shall not be deemed to be either an officer or employee of a public entity. (Ord. 93-0019 § 2 (part), 1993.)

6.04.082 Qualifying hours.

“Qualifying hours” means those hours that are counted for vacation and sick leave accrual purposes.
A. This includes:
1. The hours worked during a work period;
2. Industrial or short-term nonindustrial disability hours covered by county benefits or by California Labor Code Section 4850; and
3. Paid leaves of absence.
B. Not included is:
1. Time while receiving long-term disability benefits;
2. Authorized or unauthorized absence without pay hours;
3. Overtime hours; or
4. Regular days off. (Ord. 93-0019 § 2 (part), 1993.)

6.04.083 Represented employee.

“Represented employee” means an employee who is represented by an employee organization certified by the employee relations commission. (Ord. 93-0019 § 2 (part), 1993.)

6.04.084 Regular day off.

“Regular day off” means any day that a full-time employee is not scheduled to work. (Ord. 93-0019 § 2 (part), 1993.)

6.04.090 Section.

“Section” means a section of the ordinance codified in this Title 6, unless some other ordinance or statute is mentioned. (Ord. 93-0019 § 2 (part), 1993.)

6.04.100 Shift.

For persons employed on a 56-hour per week basis:
A. “Shift” means a period of 24 hours;
B. “On-shift” means 24 hours on duty;
C. “Off-shift” means 24 hours off duty. (Ord. 93-0019 § 2 (part), 1993.)

6.04.110 Shift employee.

“Shift employee” means any employee who is assigned on a regular basis to a POST position who, as a consequence of such assignment, receives alternative time off in lieu of the holidays provided in Sections 6.12.040 through 6.12.060 and the normal weekends of Saturday and Sunday. For purposes of this section “assignment on a regular basis” shall be deemed to be a period of not less than one calendar month. (Ord. 93-0019 § 2 (part), 1993.)

6.04.120 Subparagraph.

“Subparagraph” means a subdivision of a paragraph as defined in Section 6.04.060 of this chapter; provided, however, that subparagraphs may be referred to as either paragraphs or subparagraphs. (Ord. 93-0019 § 2 (part), 1993.)
