6.76.020 Additional information.

A. The County Forester and Fire Warden shall also serve as the fire chief of the County Fire Protection Districts without additional compensation, and the chief deputy county forester and fire warden shall also serve as the chief deputy fire chief of the County Fire Protection Districts without additional compensation.
B. The County Forester and Fire Warden is authorized to appoint persons employed in the county of Los Angeles and the County Fire Protection Districts, as he may deem necessary, as Deputy Fire Warden, Without Compensation (Item No. 9470), or Assistant Fire Warden, Without Compensation (Item No. 9469). However, no person shall be appointed to either of these positions who does not hold either a position in the county of Los Angeles or a position in one of the County Fire Protection Districts of the county of Los Angeles.
C. Persons employed on a 56-hour week basis in the fire department shall meet their continuous service requirements and basic workweek obligations, and receive holidays and bereavement leave benefits in accordance with provisions of the Salary Resolution of the Los Angeles County Fire Protection Districts, as amended. (See Appendix 6 following Title 6.)
D. In any case where the Chief Administrative Officer finds, upon investigation, that certain 56-hour personnel should be designated as less than 56-hour positions, he may so designate. The provisions for holidays, sick leave and vacation, as provided for 40-hour personnel, shall generally apply to these positions.
E. 1. Persons assigned to act as driver to the county forester and fire warden shall be compensated at a rate two schedules higher than that established for their positions in Section 6.28.050 of this code.
2. Effective with the pay period ending April 15, 2012 and upon notification to the board of supervisors by the chief executive officer that the human resources management system implementing this provision is fully operational, persons assigned to act as driver to the county forester and fire warden shall be compensated at a rate 5.6468 percent higher than that established for their classifications in Section 6.28.050 of this code.
F. Deputy Fire Chief (UC) (Item No. 0219), Assistant Fire Chief (Item No. 0217A) and all positions listed in Section 110 (2) of the Salary Resolution of the Los Angeles County Fire Protection Districts (see Appendix 6 following this title), are dual-status items, and the compensation for such positions shall be as set forth in Section 6.28.050 of this code. The proportion of salaries and wages chargeable against the County Fire Protection Districts will be in the form of a service charge to the Districts. It is the intent of this provision to provide dual status for said positions with compensation provision in both this code and in the Salary Resolution of the Los Angeles County Fire Protection Districts.
G. In any case where the director of personnel finds, upon investigation, that persons employed in the fire department as Transportation Truck Driver (Item No. 6054) are assigned to the active suppression of fires, he may authorize the payment of additional compensation to such persons during the periods of such assignment at the rate of $0.18 per hour. All payments made under this provision are subject to prior approval annually by the Chief Administrative Officer, and a report of payments made shall be submitted annually to the Chief Administrative Officer.
H. Persons employed in the following classes as of September 30, 2000, shall have the pay rate provided by Chapter 6.08 increased on October 1, 2000 by 7.5 percent:

I. Notwithstanding the provisions of Section 6.12.050, any Battalion Chief (56 Hours) (Item No. 0208) who is assigned to work as a shift employee shall be entitled to reimbursement for holidays worked and not taken and carryover of holiday time on the same basis as provided to shift employees in the memoranda of understanding for Employee Representation Units 601 and 602.
J. Any person employed in a position represented by the Fire Fighters Employee Representation Unit (Unit 601) or the Supervisory Fire Fighters Employee Representation Unit (Unit 602) who is required to provide his own transportation to Camp 16 to engage in fire fighting or fire prevention activities shall receive, in addition to all other compensation provided by this code $12.00 per round trip.
K. 1. Lifeguard personnel assigned to night duty at beaches shall be assigned and work on a 60-hour or 84-hour week basis, and compensation allowed shall be that set forth in Section 6.28.140 of this code.
2. Employees so assigned to this 60-hour or 84-hour shift shall be considered on the same basis and be entitled to and receive the same rights and privileges as provided for all other five-day, 40-hour employees.
L. 1. Persons employed on a permanent or recurrent basis in the fire department who are assigned on a regular basisto beach and rescue boat operations in and around Catalina Island and are required, during such assignment, to reside on Catalina Island shall be entitled to compensation at a rate four schedules higher than that established for their respective positions in Section 6.28.050 or Section 6.28.140 of this code during such assignment.
2. Effective with the pay period ending April 15, 2012 and upon notification to the board of supervisors by the chief executive officer that the human resources management system implementing this provision is fully operational, all provisions in Section 6.76.020, subsection L.1 shall remain in effect except that such persons meeting the aforementioned requirements shall be entitled to compensation at a rate 11.6125 percent higher than that established for their respective positions in Section 6.28.050 or Section 6.28.140 of this code during such assignment.
M. Notwithstanding any other provision of this code, when authorized by the board of supervisors or the Chief Administrative Officer, overtime ordered and worked by employees in positions contained in the Beach Lifeguards or Supervisory Beach Lifeguards Representation Units due to an unusual major event, such as major fire, flood or civil disturbance, which has been specifically so designated by the board of supervisors or the Chief Administrative Officer, shall be paid at the rate of time and one-half, calculated pursuant to subsection B of Section 6.15.070 of this code.
N. Notwithstanding any other provision of this code, a person employed on a daily recurrent basis as an Ocean Lifeguard (Item No. 2923E) who is reinstated pursuant to the Civil Service Rules following a release from daily recurrent status shall be entitled to have restored any previously earned and unused full-pay sick leave; provided, however, that such leave shall otherwise be deemed available for use in accordance with those conditions and limitations that affect full-pay sick leave benefits earned and accrued by other employees employed on a daily recurrent basis.
O. 1. Beginning July 1, 2005, any person employed in one of the following positions shall, if certified as an Emergency Medical Technician - 1, receive a bonus of 14 standard salary levels provided such person's performance is "Competent" or better:

2. Effective with the pay period ending April 15, 2012 and upon notification to the board of supervisors by the chief executive officer that the human resources management system implementing this provision is fully operational, all provisions in Section 6.76.020, subsection O.1. shall remain in effect except that such persons meeting the aforementioned requirements shall receive a bonus of 3.5574 percent.
P. Beginning July 1, 2005, any safety fire fighting employee employed in one of the following positions shall, if certified as an Emergency Medical Technician -1, have the pay rate provided by Chapter 6.08 increased by 3.5 percent provided such person's performance is "Competent" or better or, in the case of persons paid in accordance with the provisions of Title 6, Chapter 6.08, Part 3 of the Code, "Met Expectations" or better:

Q. Command Pay.
1. Eligibility. Beginning January 1, 2006, each safety fire fighting employee employed in one of the following positions shall be eligible to receive command pay based on years of completed aggregate service in the County of Los Angeles in accordance with the implementation schedule provided in paragraph 4:

2. The command pay provided for in this Subsection Q shall be contingent on completion of the requisite aggregate safety fire fighting service with the County of Los Angeles as set forth in Subsection 3 below. In the case of mergers or consolidations, as provided in Section 6.02.040 of this title, agency hire date as a safety employee shall be recognized for the purpose of determining aggregate service. Neither lateral fire fighting experience, military service buy-back, nor non-safety County work experience shall count toward meeting the aggregate service requirements for command pay;
3. The command pay provided by this subsection shall only be paid upon departmental certification that the employee's performance is "Competent" or better in the case of persons paid in accordance with provisions provided by Chapter 6.08, Part 1 or "Met Expectations" or better in the case of persons paid in accordance with the provisions provided by Chapter 6.08, Part 3. Whenever an "Unsatisfactory Performance," "Failed to Meet Expectations," "Improvement Needed Performance," or "Improvement Needed in Meeting Expectations" evaluation is filed with the director of personnel, the command pay shall be cancelled and may not be restored until a "Met Expectations" or "Competent" or better rating is filed;
4. Command pay based on years of aggregate service shall be implemented as follows:
a. 25 years.
(1) Beginning January 1, 2006, in addition to the compensation provided for in Section 6.28.050, an eligible employee under this subsection shall receive additional compensation that is 14 levels higher in the case of persons paid in accordance with provisions provided by Chapter 6.08, Part 1 or additional compensation that is 3.5 percent higher in the case of persons paid in accordance with provisions provided by Chapter 6.08, Part 3 than he would otherwise be entitled to receive upon the completion of 24 years of aggregate County service;
(2) Effective with the pay period ending April 15, 2012 and upon notification to the board of supervisors by the chief executive officer that the human resources management system implementing this provision is fully operational, all provisions in Section 6.76.020, subsection Q.4.a.(1) shall remain in effect except that those persons paid in accordance with the provisions provided by Chapter 6.08, Part 1 of this code and who meet the aforementioned requirements shall receive additional compensation that is 3.5574 percent higher than they would otherwise be entitled to receive upon the completion of 24 years of aggregate County service.
b. 30 years.
(1) Beginning July 1, 2006, in addition to the compensation provided for in Section 6.28.050, an eligible employee under this subsection shall receive additional compensation that is 30 levels higher in the case of persons paid in accordance with provisions provided by Chapter 6.08, Part 1 or additional compensation that is 7.5 percent higher in the case of persons paid in accordance with provisions provided by Chapter 6.08, Part 3 than he would otherwise be entitled to receive upon the completion of 29 years of aggregate County service.
(2) Effective with the pay period ending April 15, 2012 and upon notification to the board of supervisors by the chief executive officer that the human resources management system implementing this provision is fully operational, all provisions in Section 6.76.020, subsection Q.4.b.(1) shall remain in effect except that those persons paid in accordance with the provisions provided by Chapter 6.08, Part 1 of this code and who meet the aforementioned requirements shall receive additional compensation that is 7.7783 percent higher than they would otherwise be entitled to receive upon the completion of 29 years of aggregate County service.
R. Notwithstanding any other provision of this Title 6, persons employed as Fire Suppression Aid (Item No. 0196) shall, commencing December 1, 2005, be placed one step higher within the indicated salary range as if they were compensated on a five step salary range where the first step of the range is the second step of the indicated salary schedule and the fifth step of the range is the fifth step of the salary schedule which is two standard salary schedules above the indicated salary schedule. The rate or rates established by this provision constitute a base rate.
S. Fitness for Life Pay.
1. Beginning July 1, 2006, the pay rate for any safety fire fighting employee employed in one of the following classes provided by Chapter 6.08 shall be increased by 3 percent for the Fitness For Life Program that has been otherwise approved by the Board for represented safety employees, provided such person's performance is "Competent" or better or, in the case of persons paid in accordance with the provisions of Title 6, Chapter 6.08, Part 3 of the Code, "Met Expectations" or better:

2. Effective July 1, 2007, continuation of the bonus provided in Subsection S1 shall be contingent upon successful completion of the annual Fitness for Life Program, as approved by the board of supervisors for represented fire fighting safety employees, provided the performance of a person paid in accordance with the provisions of Title 6, Chapter 6.08, Part 1 is "Competent" or better; or in the case of a person paid in accordance with the provisions of Title 6, Chapter 6.08, Part 3 performance is "Met Expectations" or better.
3. a. Beginning October 1, 2006, the pay rate for a person employed in any safety lifeguard classification listed below shall be increased 12 levels for a person paid in accordance with Title 6, Chapter 6.08, Part 1 of the Code upon successful completion of the Fitness for Life Program, as approved by the board of supervisors for represented safety lifeguard employees providing such person's performance is rated "Competent" or better; in the case of a person paid in accordance with the provisions of Title 6, Chapter 6.08, Part 3 of the Code, the pay rate shall be increased 3 percent upon successful completion of the Fitness for Life Program providing such person's performance is rated "Met Expectations" or better:

b. Effective with the pay period ending April 15, 2012 and upon notification to the board of supervisors by the chief executive officer that the human resources management system implementing this provision is fully operational, all provisions in Section 6.76.020, subsection S.3.a shall remain in effect except that the pay rate for such persons meeting the aforementioned requirements and paid in accordance with the provisions provided by Chapter 6.08, Part 1 of this code shall be increased 3.0416 percent.
4. Effective July 1, 2007, continuation of the bonus provided in Subsection S3 shall be contingent upon successful completion of the annual Fitness for Life Program, as approved by the board of supervisors for represented fire fighting safety employees, providing the performance of a person paid in accordance with the provisions of Title 6, Chapter 6.08, Part 1 is "Competent" or better; or in the case of a person paid in accordance with the provisions of Title 6, Chapter 6.08, Part 3 performance is "Met Expectations" or better.
5. The Fitness for Life Pay provisions shall remain in effect through December 31, 2012. The rate or rates established by this provision do not constitute a base rate.
T. Beginning October 1, 2007, any person employed as a Head Fire Dispatcher (Item No. 2437) shall, if certified as an Emergency Medical Dispatcher, receive a bonus of 22 standard salary levels provided that all of the following conditions have been met:
1. Proof that Emergency Medical Dispatcher Certification has been provided;
2. Proof that continuing education requirements have been met;
3. A rating of "Competent" or higher on the employee's most recent performance evaluation. New hires shall receive the bonus, as long as they maintain a competent level of performance; and
4. The employee is not on plan for improvement as part of an overall Improvement Needed performance evaluation.
U. Beginning October 1, 2007, employees in the classification of Hazardous Material Control Manager, Fire (Item No. 4406) shall receive a bonus of $2.50 for each hour assigned regularly scheduled standby service during off-duty periods.
