Sec. 11B.04.010. - Registration requirements.
A.
Registration required. All vineyard and orchard frost protection systems in the Russian River watershed using frost protection water shall be registered annually with the agricultural commissioner. A separate registration shall be required for each site.
B.
Application and action. Applications for registration shall be filed with the agricultural commissioner on county application forms between January 1 and March 1 of each year. Each application shall include all required fees, and any information, materials, and submittals required by the agricultural commissioner. Upon receipt of a complete application, the agricultural commissioner shall register the vineyard or orchard frost protection system and issue a registration receipt.
C.
Inspection. The vineyard or orchard frost protection system for which an application is filed shall be subject to inspection by the agricultural commissioner to verify the information in the application.
D.
Eligibility for filing. An application may only be filed by the owner or authorized agent of the owner of the subject site.
E.
Ministerial action. The board of supervisors hereby declares that the review of applications and issuance of registration receipts pursuant to this section shall be ministerial actions. This chapter shall be interpreted, administered, and construed in light of this legislative intent.

Sec. 11B.04.020. - Comprehensive frost protection monitoring requirements.
A.
Frost protection monitoring program. All owners of vineyard and orchard frost protection systems in the Russian River watershed using frost protection water shall participate in the Sonoma County Russian River Frost Protection Monitoring Program. The agricultural commissioner shall develop the program in consultation with the National Marine Fisheries Service, the California Department of Fish and Game, and the State Water Resources Control Board, and shall not change or modify the program without consulting with those agencies. The agricultural commissioner may contract with a qualified nonprofit organization operate the program.
B.
Site access. All owners of vineyard and orchard frost protection systems in the Russian River watershed using frost protection water shall provide adequate access to their sites for the agricultural commissioner to install and maintain necessary stream gages and other equipment for the program and to collect data for the program.

A.
Fee schedule. The board of supervisors shall establish a schedule of fees for the processing of applications, and the operation of the Sonoma County Russian River Frost Protection Monitoring Program, required by this chapter.
B.
Timing of payment. No application shall be deemed complete until all required fees have been paid.
