Sec. 26A-17-010. - Public record.

(a)

Identification of Proprietary Information. Reclamation plans, reports, applications and other documents submitted pursuant to this chapter are public records unless it can be demonstrated to the satisfaction of the county that the release of such information, or part thereof, would reveal production, reserves or rate of depletion or other financial information entitled to protection as proprietary information. The county shall identify such proprietary information as a separate part of each application.

(b)

Protection of Proprietary Information. Any information identified as "proprietary" in subsection (a) of this section shall be treated consistent with the handling, storage, and disclosure guidelines set forth in board Resolution #96-1361, adopted October 8, 1996, or as may be amended by later board actions.
