Sec. 26A-15-010. - Responsibility.

(a)

Responsibility. The permittee, operator, property owner, their authorized agents, or any other person in control of the operation, individually or collectively, shall be responsible for the observation and compliance with all the provisions of this chapter. Such responsibility shall include the correction of any unsafe condition and the construction and maintenance of all fences and other protective devices required by the approved permit and/or reclamation plan.
