Notwithstanding anything contained elsewhere in this code to the contrary or in uncodified ordinances of the county of Sonoma, the county may waive traffic and park mitigation fees which would otherwise be payable in connection with the construction of housing for full-time agricultural employees. Prior to any such waiver, it will be necessary for the property owner to enter into a covenant in a form satisfactory to county counsel. The covenant may be signed by the planning director and shall provide for the payment of park and traffic mitigation fees then in effect in the event that the full-time agricultural employee housing is converted to any other use at a later time. Additionally, the covenant shall contain provisions which acknowledge that conversion of the full-time agricultural employee housing to any other use shall be deemed a violation of Chapter 26 of the Sonoma County Code subject to abatement. In the event that the agricultural employee housing is converted to some other residential use as the result of the termination of the agricultural use of the property, the county may deem the structure to be a nonconforming use, as opposed to a violation of Chapter 26.
