Sec. 10-49. - Article designated.
This article shall be known as the "drive-in restaurant code."

For the purpose of this article, the following terms shall have the meanings herein given:
Drive-in restaurant is an establishment located and operated within the town where food, frozen dessert or beverage is sold to the consumer and where motor vehicle parking space is provided and where such food, frozen dessert or beverage is intended to be consumed in the motor vehicle parked upon the premises or elsewhere upon the premises outside the building.
Waste material is paper, cups, straws, napkins, garbage, beverages and all other waste material intended for disposal which, if not placed in a proper receptacle, tends to create a public nuisance by rendering property unclean, unsafe and unsightly.

Sec. 10-51. - Maintenance of peace and good order.
The operator of a drive-in restaurant located and operated within the town shall maintain quiet and good order upon the premises of a drive-in restaurant and shall not permit disorderly or immoral conduct or loitering. The operator shall not cause or create any noise or other nuisance on the parking area of a drive-in restaurant whereby the quiet and good order of the premises or of the neighborhood is disturbed.

Sec. 10-52. - Automobile noise.
No person on the premises of a drive-in restaurant shall race the motor of any motor vehicle, needlessly bring to a sudden start or stop any motor vehicle, blow any horn, or make or cause to be made any other loud or unseemly noise, nuisance or disturbance whereby the quiet and good order of the premises or of the neighborhood is disturbed.

The operator of a drive-in restaurant shall:
(1)
At least once in twenty-four (24) hours dispose of waste materials which tend to create a public nuisance on the premises.
(2)
Keep the premises whereon the drive-in restaurant is located, together with the parking area and that portion of any street or alley adjoining the drive-in restaurant free from waste material, and shall, during the hours of operation of each day of operation, have on duty on the premises an employee whose principal duty shall be to remove trash and waste material from such premises.

Provide the drive-in restaurant with a sufficient number of adequate refuse containers.

Sec. 10-54. - Throwing, depositing waste.
No person shall place, throw or deposit any waste material upon the outside premises or parking area of a drive-in restaurant or on any street, alley or adjoining property or in the vicinity of a drive-in restaurant, except in adequate receptacles provided for that purpose, nor shall the operator of a drive-in restaurant permit such conduct.

Sec. 10-55. - Curb service to auto parked in public street prohibited.
It shall be unlawful for any person to engage or take part in what is commonly known as "curb service," that is, the delivery by a merchant, or his agent, to the occupant, or person in charge of such motor car, and acceptance by such occupant, or person in charge of such motor car, of food or drinks for consumption by the occupant or occupants of such motor car, while said motor car is parked on a public street of the town.
