ARTICLE V. - DRIVEWAYS


Sec. 17-57. - Permit required.

It shall be unlawful for any person to construct a driveway across any public sidewalk, walkway or parkway or into any public street or cut any curb for such purpose without first having obtained a permit therefor as required herein.

Sec. 17-58. - Application; approval.

An application for a permit required by this article shall be made to the building inspector and shall state, among other things, the location, grade and dimensions of the proposed driveway and the purpose for which it is desired. If the proposed driveway complies with the provisions of this article, a permit therefor shall be approved.

Sec. 17-59. - Driveways connecting with state highways.

Any applicant desiring to construct a driveway or driveways connecting with any state highway located within the corporate limits of the town shall make application as provided above. In such case, however, the building inspector shall forward the application with his endorsement to the office of the District Engineer, N. C. State Highway Commission for the district in which Chapel Hill is located. No construction permit shall be issued by the town building inspector until the application therefor has been approved by the N. C. State Highway Commission. The minimum standards for entrances to highways from commercial establishments, as set forth in the regulations of the N. C. State Highway Commission designated as "Manual on Driveway Entrance Regulations," as adopted November 5, 1965, effective April 1, 1966, shall apply, except as herein modified.

(1)

No driveway governed by this section shall exceed twenty-five (25) feet in width as determined by measurements parallel to the adjacent road, except that entrances to gasoline service stations from state system public streets may have a maximum width of thirty-six (36) feet.

(2)

Normally the radius of the curb-return in a driveway governed by this section will be thirty (30) inches measured along the back of the curb. Variations may be approved by the superintendent of public works where justified.

(3)

The flared portion of driveways governed by this section shall not encroach on adjacent property except in the case of a common driveway.

(4)

On a corner lot, no portion of any driveway governed by this section shall be nearer than fifteen (15) feet to the intersecting right-of-way lines of adjacent public streets.

(5)

No driveway apron shall extend out into the public street beyond the face of the curb or proposed curbline, and under no circumstances shall such driveway apron extend into the gutter area.

(6)

Slope and drainage on all driveways governed by this section shall conform to the existing curb line conditions and shall be inspected by the town superintendent of public works.

Sec. 17-60. - Driveways for business or commercial areas.

Driveways for business or commercial areas shall comply with this section:

(1)

The angle of driveways shall not be less than forty-five (45) degrees with the line of the road on which they face.

(2)

No portion of any driveway shall be nearer than five (5) feet to any interior property line measured along the adjacent public street line.

(3)

Not more than two (2) driveways shall be permitted to service one (1) business or commercial installation from one (1) street, and one-third (1/3) of the lot frontage on the adjacent public street shall be reserved for safety island purposes; provided, that if the frontage is not sufficient to provide two (2) satisfactory driveways with one-third (1/3) reserved for islands, a single combined entrance and exit with a maximum width of twenty-five (25) feet shall be provided, except as otherwise provided in this article.

(4)

In areas where no curb and gutter is installed, curbs placed to form island areas shall be constructed along the proposed curbline.

Sec. 17-61. - Driveways for residences.

Driveways for residences shall comply with this section:

(1)

Not more than two (2) driveways shall be permitted for each residential lot.

(2)

When two (2) driveways are constructed, the minimum distance between driveways shall be thirty (30) feet.

(3)

No portion of any driveway shall be nearer than two and one-half (2½) feet to any interior property line measured along the adjacent public street line.

Sec. 17-62. - Weight-bearing capacity of sidewalk used with private driveway.

No portion of a paved or bricked sidewalk used in conjunction with a private driveway shall be hereafter constructed with a weight-bearing strength equivalent to less than six (6) inches of concrete.

Sec. 17-63. - Replacement of cut curb.

When a curb is cut, the entire section of the curb and gutter shall be removed and replaced with a standard, concrete driveway section.

Sec. 17-64. - Driveway culverts.

All driveway culverts shall be made of reinforced concrete and of sufficient size to accommodate the drainage requirement but in no case shall be less than twelve (12) inches. Pipe shall be set to line and grade and all joints wiped with cement.

Sec. 17-65. - Responsibility of town for grading when public street improvement leaves driveway high or low on new street grade.

When public streets are improved by the construction of curb and gutter, and driveways are left either high or low compared to the new public street grade, the responsibility of the town in connection with this improvement project shall be limited to doing sufficient grading so as to allow reasonable ingress and egress by motor vehicles from the newly constructed public street to existing driveways, and that no surface other than Chapel Hill gravel be provided; and the cost of making such minor alterations to existing driveways be considered part of the total cost of the improvement project.

Sec. 17-66. - Limit on driveways per lot; cost of additional or wider driveways.

Each lot along the public street to be improved shall be allowed one driveway not exceeding twelve (12) feet in width for each existing lot, such driveway to be charged to the cost of the improvement project. For any additional driveways on a lot, or for driveways in excess of twelve (12) feet in width, a special charge would be placed against the property involved to cover the difference between the cost per foot of curb and gutter and the cost per foot of the driveway or the extra width.
