Sec. 21-19. - Police regulations.
It shall be prohibited for any person to park an automobile or vehicle of any kind in violation of any police regulation relative to parking. Provided, that there shall be some legible instructions against parking before any person can be found guilty of violating these police regulations. No motor vehicle shall be parked in any other place or section where there is displayed an official sign of the police division bearing the notice, "No Parking."

Sec. 21-20. - Interference with traffic.
It shall be unlawful for anyone to park an automobile or vehicle of any kind, or allow one to stand on any public street in such a manner as to interfere with the traffic on any public street, sidewalk or alley.

Sec. 21-20.1. - Parking on sidewalk prohibited.
It shall be unlawful for anyone to park a motor vehicle or allow one to stand on any public sidewalk within the Town of Chapel Hill. For the purposes of this section, a "public sidewalk" is defined as any area within the right-of-way of a public street which has curb and gutter, and which said area is separated from that designed and normally used for the operation of a motor vehicle by said curb, and shall not be construed to include the shoulder or any unpaved portion of a right-of-way of a paved road on which curb and gutter does not separate the travelled portion from that portion of the right-of-way used for other purposes.

(a)
The following areas are hereby declared to be fire lanes which have been determined to be necessary to the proper fire protection of the Town of Chapel Hill. Where there is legible instruction at the fire lane against parking therein, the police department is hereby authorized to remove, tow in, and impound automobiles and vehicles of any kind parked in contravention of this section and to remove any other form of obstruction from said fire lanes. The owner shall be responsible for and pay storage and moving costs for any vehicle removed pursuant to the provisions of this section. The police department shall use reasonable diligence to notify the owner of the removal and storage of such vehicles. This declaration is without prejudice to the town's right to assert at a later date that said areas are public rights-of-way.

(b)
Upon a determination by the fire chief or the fire chief's designee that a fire lane is essential on private property for the protection of life, safety and property, the town manager may cause such further fire lanes to be properly posted as such. Upon installation of signs designating such fire lanes, said fire lanes shall be regulated by this Code in the same manner as those listed in subsection (a).
(c)
Upon a determination by the fire chief or the fire chief's designee that a fire lane is essential on public right-of-way, whether or not maintained by the town, or on town-owned property for the protection of life, safety and property, the town manager may cause such further lanes to be properly posted as such. Upon the installation of signs designating such fire lanes, said fire lanes shall be regulated by this Code in the same manner as those listed in subsection (a).
(d)
The posting of signs and marking of parking spaces as fire lanes on public or private property where such areas have not been designated as fire lanes by the town or some other authorized public agency is prohibited unless such signs and markings state that they are privately established and enforced.

Sec. 21-20.3. - Use of certain fire lanes.
It shall be unlawful for any person to drive a motor vehicle, except for a motor vehicle being used for emergency purposes such as fire, police and emergency medical use, on any fire lane specifically identified in this section. The fire lanes to which this prohibition applied are as follows:

It shall be unlawful to park an automobile or vehicle of any kind within fifteen (15) feet in either direction of any fire hydrant or sprinkler or standpipe connection or to park any such vehicle in a manner so as to otherwise obstruct a fire hydrant or sprinkler or standpipe connection, provided, however, that this section shall apply with respect to sprinkler and standpipe connections only where signs are posted indicating these parking restrictions.

The police and fire departments are authorized to issue civil penalties for violation of ordinances or regulations including but not limited to sections 21-20.2 and 21-20.3, which prohibit parking or obstruction of access to fire lanes, hydrants, standpipe and sprinkler system connections.

Sec. 21-22. - Overtime parking.
No person shall park or leave standing a vehicle of any kind upon any public street and leave the same unmoved for a period of time in excess of forty-eight (48) hours.

Sec. 21-23. - Parking on parkway area planted with grass or shrubbery.
No motor vehicle shall be parked on any parkway area which has been planted with grass or shrubbery in any part of the town.
Sec. 21-24. - Parking during snow storm.
It shall be unlawful to park an automobile or vehicle of any kind, or leave one parked on Franklin Street or Rosemary Street between Spring Lane and the Carrboro town limits or on the portion of Henderson Street, North Columbia Street, North Church Street, Roberson Street, or Graham Street lying between Franklin Street and Rosemary Street after two (2) inches of snow have fallen on such public streets and before the snow has been removed therefrom.

Sec. 21-25. - Parking on median of Barclay Road.
It shall be unlawful to park an automobile or vehicle of any kind on the median of Barclay Road between Martin Luther King, Jr. Boulevard and the western corporate limits.

Sec. 21-25.1. - Abandoned vehicles on town property.
It shall be unlawful to leave any motor vehicle on property owned or operated by the town for longer than twenty-four (24) hours. Any motor vehicle left on property owned or operated by the town for longer than twenty-four (24) hours shall be considered abandoned and shall be subject to towing and impoundment; provided, however, that such vehicle shall not be subject to being towed under the provisions of this article for such a violation until notice of violation shall be placed on the vehicle forty-eight (48) hours prior to said towing.

Sec. 21-25.2. - Abandoned vehicles on public streets.
It shall be unlawful to leave any motor vehicle on a public street or highway for longer than seven (7) days. Any motor vehicle left on a public street or highway for longer than seven (7) days shall be considered abandoned and shall be subject to towing and impoundment; provided, however, that such vehicle shall not be subject to being towed under the provisions of this article for such a violation until notice of violation shall be placed on the vehicle forty-eight (48) hours prior to said towing.

Sec. 21-26. - Parking in alleys.
(a)
It shall be prohibited to park an automobile or vehicle of any kind at any time in the alleyway located between East Rosemary Street and East Franklin Street, which alleyway extends southwardly from the southern line of East Rosemary Street just west of the Chapel Hill Parking Facility for a distance of approximately one hundred eighty (180) feet turning thence eastwardly approximately parallel to East Rosemary Street three hundred seventy-five (375) feet more or less to the property line of the U.S. Post Office; then extending northwardly one hundred sixty (160) feet more or less along the post office property to the southern line of Rosemary Street, except that in the portion parallel to Rosemary Street parking shall be permitted for the active loading and unloading of trucks. Trucks being loaded or unloaded must be parked in the southern one-half of the alley and shall not at any time completely block the alley.
Traffic on the portion of the above described alley adjacent to the post office property shall be only northbound traffic.
All traffic emerging from either end of the alley onto Rosemary Street shall come to a complete stop and shall yield right-of-way to any traffic on Rosemary Street.
(b)
It shall be prohibited to park an automobile or vehicle of any kind at any time within the alleyway which extends westwardly from the coffee shop alleyway to the Carolina Theater Building, said alleyway being located between the property of the Port Hole Restaurant and the University Service Plants Building.
(c)
It shall be prohibited to park an automobile or vehicle of any kind in the alley approximately midway the block between Church Street and Roberson Street extending one hundred forty-four (144) feet north of Rosemary Street; also it shall be prohibited to park an automobile or vehicle of any kind in the alleyway extending ninety-four (94) feet west or one hundred fifty (150) feet east of the west and east right-of-way lines respectively of the above said alley.

Sec. 21-27.2. - Special parking permits.
The town manager may issue a special parking permit which permits the holder thereof to park the vehicle displaying such permit at a location on a public street in a residential area where parking is otherwise prohibited. No more than five (5) special parking permits shall be in effect simultaneously for any lot, as defined by the "Ordinance Providing for the Zoning of Chapel Hill and Surrounding Areas", regardless of the number of housing units thereon.
(a)
If the town manager shall find that:
(1)
The applicant is domiciled on a public street on both sides of which adjacent to applicant's domicile, parking is simultaneously prohibited or, the applicant lives on a corner lot at the intersection of two (2) streets, on one of which parking in the vicinity of the intersection is simultaneously prohibited on both sides of that public street and on the other of which parking in the vicinity of the intersection is prohibited on one side or both sides of that other public street; and
(2)
The applicant has a vehicle which has no practical way of parking off the public right-of-way; and
(3)
In the opinion of the town engineer, it would cost more than eight hundred dollars ($800.00) to construct a parking space for applicant's vehicle off the public right-of-way; or in the opinion of the town manager, such construction would require the destruction of an area or object of historical or natural significance to the town as a whole;
then the town manager may issue a special parking permit renewable annually upon a finding of no change in applicant's circumstances.
(b)
If the town manager shall find that:
(1)
The applicant is domiciled on a public street on both sides of which adjacent to applicant's domicile, parking is simultaneously prohibited or, the applicant lives on a corner lot at the intersection of two (2) streets, on one of which parking in the vicinity of the intersection is simultaneously prohibited on both sides of that public street and on the other of which parking in the vicinity of the intersection is prohibited on one side or both sides of that other public street; and
(2)
The applicant has a vehicle which he has no practical way of parking off the public right-of-way; and
(3)
In the opinion of the town engineer it would be possible to construct a parking space for applicant's vehicle for eight hundred dollars ($800.00) or less;
then the town manager may issue a special parking permit for a period of up to one year; however, such permit shall not be renewed except upon a new finding that the circumstances contemplated in section 21-27.2(a) obtain.
(c)
If the town manager shall find that:
(1)
The applicant is domiciled on a public street on both sides of which adjacent to applicant's domicile, parking is simultaneously prohibited or, the applicant lives on a corner lot at the intersection of two (2) streets, on one of which parking in the vicinity of the intersection is simultaneously prohibited on both sides of that public street and on the other of which parking in the vicinity of the intersection is prohibited on one side or both sides of that other public street; and
(2)
There is no practical way in which two (2) guest vehicles in addition to applicant's own vehicle (if any) may be parked off the public right-of-way; and
(3)
In the opinion of the town engineer, it would cost more than eight hundred dollars ($800.00) to construct a parking space for applicant's vehicle off the public right-of-way; or in the opinion of the town manager, such construction would require the destruction of an area or object of historical or natural significance to the town as a whole;
then the town manager may issue up to two (2) one-year movable special parking permits, renewable annually upon a finding of no change in applicant's circumstances, for use by guests of the applicant.
(d)
If the town manager shall find that:
(1)
The applicant is domiciled on a public street on both sides of which adjacent to applicant's domicile, parking is simultaneously prohibited or, the applicant lives on a corner lot at the intersection of two (2) streets, on one of which parking in the vicinity of the intersection is simultaneously prohibited on both sides of that public street and on the other of which parking in the vicinity of the intersection is prohibited on one side or both sides of that other public street; and
(2)
There is no practical way in which two (2) guest vehicles in addition to applicant's own vehicle (if any) may be parked off the public right-of-way; and
(3)
In the opinion of the town engineer it would be possible to construct a parking space for applicant's vehicle for eight hundred dollars ($800.00) or less;
then the town manager may issue up to two (2) one-year movable special parking permits for use by guests of the applicant; however, such permits shall not be renewed except upon a finding that the circumstances contemplated in section 2-27.2(c) obtain.
(e)
If the town manager shall find that:
(1)
The applicant is a private nonprofit agency with an office on a public street or streets on both sides of which adjacent to applicant's office parking is simultaneously prohibited; and
(2)
There is no practical way in which client vehicles in addition to the vehicles of the applicant's staff may be parked off the public right-of-way;
then the town manager may issue up to a total of thirty (30) special parking permits for use by clients and staff in any combination of annual permits or mobile guest permits. The manager may also issue additional temporary one-day permits as necessary for client and staff parking.
(f)
Any decision of the town manager regarding special parking permits may be appealed by petition to the council.
(g)
The chief of police may, when special events such as weddings, funerals, etc., will cause a temporary increase in the need for parking at a particular location, permit parking in area from which parking is normally prohibited when application is made at least twenty-four (24) hours in advance and such parking will not unduly threaten the public safety and welfare.

Sec. 21-27.2.1. - Judicial/post office parking.
The west side of Henderson Street from a point one hundred forty (140) feet north of Franklin Street to a point two hundred sixty (260) feet north of Franklin Street shall be reserved as judicial official parking, between 7:00 a.m. and 5:00 p.m., Mondays through Fridays at locations authorized by the manager and designated by appropriate signs and/or markings; and parking shall be prohibited in said area during the times and days noted above without a special permit as authorized below.
The manager is authorized to issue special judicial official permits to district court officials which allows the permit holder to park vehicles, displaying such permits, in the designated spaces where parking is other prohibited.

Sec. 21-27.2.2. - Special parking permits.
The manager is authorized to issue annually special parking permits to residents of the streets listed below to park on said streets where parking is otherwise prohibited. Such parking shall be permitted only in areas displaying signs designating zones for parking by residential permit.

The number of special parking permits issued for a given residence shall not exceed the number of licensed vehicles registered to the residence address. The manager is further authorized to issue a maximum of two (2) additional guest parking permits per residence address. All permits shall be renewable annually, with current proof of residence and vehicle license required at the time of permit issuance and/or renewal.

Sec. 21-27.2.3. - Town hall parking.
The south side of Stephens Street from a point feet one hundred eighteen (118) feet east of the centerline of North Columbia Street to a point three hundred ten (310) feet west of the centerline of Martin Luther King, Jr. Boulevard shall be reserved for town hall parking, between 8:00 a.m. and 5:00 p.m., Monday through Friday as designated by appropriate signs and/or markings; and parking shall be prohibited in said area during the times and days noted above without a special permit as authorized below.
The manager is authorized to issue special town employee permits that allows the permit holder to park vehicles, displaying such permits, in the designated area where parking is otherwise prohibited.

Sec. 21-27.2.5. - Parking allowed during special events.
Parking is allowed on east side of North Roberson Street between West Rosemary Street and Mitchell Lane during special events at the Hargraves community Center. For purposes of this section, a special event is defined as any activity other than normal programming as determined by the administrative staff at the Hargraves Community Center.

Sec. 21-27.3. - Bike lane overlay zones.
During the following periods it shall be unlawful to park an automobile or vehicle of any kind on the designated areas of the following public streets:

Sec. 21-27.10. - No parking during certain hours except by mixed use permit.
The town manager may issue special parking permits which permits the holder thereof to park the vehicle displaying such permit at a location on a public street in mixed zoning area where parking is otherwise prohibited. The town manager may establish additional standards and procedures for implementation and distribution of special parking permits to the adjacent employers who may assign them to their employees and patrons.

Sec. 21-28. - No parking, miscellaneous regulations.
Parking shall be restricted or prohibited as follows:
(a)
On Franklin Street except parallel to curb with right-hand wheels not more than twelve (12) inches from the curb; on Cameron Avenue between South Columbia Street except parallel to the curb on either side of said street with one (1) front wheel and one (1) rear wheel being within twelve (12) inches of the curb.
(b)
It shall be unlawful to leave an automobile or vehicle, of any kind, unattended between 1:00 a.m. and 6:00 a.m. on Columbia Street between Franklin Street and Rosemary Street or on Franklin Street between Columbia and Henderson Street.
(c)
On either side of South Columbia Street between Cameron Avenue and McCauley Street, except temporarily for the purpose of receiving or discharging passengers.
(d)
It shall be unlawful to stop a vehicle to load or unload passengers on either side of Estes Drive between the west driveway of the Guy B. Phillips Junior High School, and the intersection of Estes Drive and Caswell Road.
(e)
It shall be unlawful to load or unload passengers of any kind on any of the four ramps or other parts of the traffic interchange at the intersection of US 15-501 ByPass and NC 54.
(f)
It shall be unlawful to load or unload passengers on the east side of North Columbia Street from Rosemary Street to a point two hundred (200) feet north of the northern right-of-way line of Rosemary Street, and from North Street to a point two hundred (200) feet north of the northern right-of-say line of North Street.
(g)
It shall be unlawful to park so as to create a hazard or significant obstruction to the normal movement of traffic.
(h)
It shall be unlawful to park a motor vehicle so as to block a private driveway.
(i)
It shall be unlawful to park within fifteen (15) feet in either direction of a fire hydrant.
(j)
It shall be unlawful to park so as to hinder egress from the entrance to a fire station or otherwise significantly impede provision of an essential town service.
(k)
It shall be unlawful to obstruct a fire lane or a bicycle lane.

From and after the effective date of this section [September 23, 1985], the town manager is hereby authorized and directed to cause spaces to be marked off and provided at or about the following intersections of the public streets, hereinafter named which shall be so marked and designated by appropriate lines, words or signs as "bus stops." Each of the spaces hereafter designated, when so marked, shall be for use as a bus stop by licensed and franchised motor buses operated for the public transportation system, and in which spaces said motor buses shall be authorized to stop for the purpose of receiving and discharging passengers. It shall be prohibited for any other vehicle to park in such designated bus stops.
Key to listing of stops: The letter under direction (N, S, E or W) indicates the general direction (north, south, east or west) of the road on which the stop is located. In the case where a street does not traverse due north-south or east-west, the predominate direction of travel is used. The "From" and "To" columns indicate the stop's distance in feet from the listed intersection.

Sec. 21-28.2. - Parking in off-street parking facilities owned or operated by the town.
(a)
Any motor vehicle parked in a parking facility owned or operated by the town, when such facility is clearly designated as such by a sign no smaller than twenty-four (24) inches by twenty-four (24) inches, which sign states the ordinance regulations with respect to that lot and which is proximately displayed at the entrance thereto, when parked in violation of an ordinance, may be removed from such facility to a place of storage operated by the Town of Chapel Hill and violations shall be subject to civil penalty as provided in section 21-38 of the Town Code. The registered owner of that vehicle shall become liable for removal and storage charges. Any person who removes a vehicle pursuant to this section shall not be held liable for damages for the removal of the vehicle to the owner, lienholder or other person legally entitled to the possession of the vehicle removed; however, any person who intentionally or negligently damages a vehicle in the removal of such vehicle, or intentionally or negligently inflicts injury upon any person in the removal of such vehicle, may be held liable for any damages.
(b)
No vehicle shall be parked in an off-street parking facility owned or operated by the town except in a marked parking space or area; no vehicle shall be parked without authorization in a space designated as reserved (by a sign at the space or at the entrance to the off-street parking facility) except for the purpose for which the space is reserved. No vehicle shall be parked in a town operated park and ride lot except for the purpose of the driver riding Chapel Hill Transit or another public transit provider. A vehicle parked in violation of this subsection may be removed pursuant to procedures in the Chapel Hill Code of Ordinances and may be recovered only upon payment of towing and storage charges; and violations shall be subject to civil penalty as provided in section 21-38 of the Town Code.
(c)
No vehicle shall remain for more than twenty-four (24) consecutive hours in an off-street parking facility owned or operated by the town unless such parking is authorized by rental agreement or other arrangement with the town. A vehicle parked in violation of this subsection may be removed pursuant to procedures in the Chapel Hill Code of Ordinances and may be recovered only upon payment of towing and storage charges; and violations shall be subject to civil penalty as provided in section 21-38 of the Town Code.
(d)
The town manager is authorized but not required to implement permit procedures and other administrative procedures to carry out the purposes of this section.

Sec. 21-28.3. - Parking restricted to driveways on certain privately owned lots.
(a)
Pursuant to the authority contained in Section 3, Chapter 97 of the 2000 Session Laws of the North Carolina General Assembly, and upon the request of the owners of the properties designated in paragraph (c) of this section, parking of motor vehicles shall be prohibited on the designated properties, except in driveways.
(b)
For purposes of this section, a "driveway" shall include any paved or graveled area established on the subject property for the parking of automobiles or any other area otherwise clearly demarcated by the owner for parking of automobiles.
(c)

(d)
An owner of any property listed in paragraph (c) may, upon written request to the town manager or his designee, request a temporary suspension of the regulations applicable to his property by this section. The manager is authorized to grant such suspensions for up to 24 hours at a time and to establish any necessary rules for implementation of such temporary suspensions.
(e)
An owner of any property listed in paragraph (c) may, upon written request to the town manager, have an ordinance placed on the town council's agenda to repeal the regulations established by this section.
(f)
The parking prohibitions established in this section shall become effective when an appropriate sign giving notice thereof shall be erected by the property owner.
(g)
Nothing in this section shall be construed as modifying any otherwise applicable regulations of the town, including but not limited to, any land use management ordinance regulations pertaining to the use of front yards of residential lots for parking of automobiles.
