Sec. 23-44. - Owner responsible for drainage across private property.

Drainage across private property is primarily the responsibility of the owner of the property.

Sec. 23-45. - Drainage to be installed to town specifications, and by or under direction of town.

Because the adequacy of the drainage installed may have an effect on other property, all drainage should be installed according to town specifications regarding size and material. To insure proper installation, the town should install, or have installed, all storm systems.

Sec. 23-46. - General specifications for drainage systems.

The following general specifications shall apply to drainage systems:

(1)

An easement for drainage must be provided by the property owner.

(2)

All material for the storm drain including pipe, catch basins, and junction boxes shall be provided by the property owner.

(3)

The town will dig the necessary ditch, install the pipe, construct the catch basins and junction boxes and backfill with the dirt taken from the ditch. All other backfill or cover material must be provided and placed by the owner. In the case of relocation of ditches, the excavation for the relocation should be done by the property owner.

(4)

No storm drain less than twelve (12) inches I.D. shall be considered part of the town system.

(5)

Drainage under streets as required by the subdivision ordinance or in connection with street paving work, shall be done according to the provisions of such policies rather than the provisions above.

(6)

All requests for assistance in providing storm sewers shall be approved in the order they were received and only when adequate funds are available in the town budget for the work.

Sec. 23-47. - Maintenance of accepted drainage systems; easement from owner.

All accepted drainage systems should be maintained by the town. To insure proper maintenance, an easement should be provided by the property owner for drainage across his property.

Sec. 23-48. - Connection of roof drain, catch basin to sanitary sewerage system.

It shall be unlawful for any person to connect any roof drain or catch basin to the sanitary sewerage system of the town.

Sec. 23-49. - Allowing storm water to enter sanitary sewerage system prohibited; disconnection; penalty.

Any connection which allows storm water to enter the sanitary sewerage system must be severed by the owner immediately upon notice from the town. Failure to discontinue any such connection within five (5) days following written notice to do so shall be a misdemeanor and each day's continuance thereof shall be a separate offense.
